ED Requests Expedited Trial in Money Laundering Cases Involving Jagan Mohan Reddy

The Enforcement Directorate (ED) has approached the Telangana High Court, requesting a swift, day-to-day trial for cases of money laundering involving former Andhra Pradesh Chief Minister Y S Jagan Mohan Reddy and others. This move is aimed at ensuring that all accused individuals personally appear in court for the prosecution complaints filed under the Prevention of Money Laundering Act (PMLA).

This investigation by the ED commenced following a First Information Report (FIR) lodged by the Central Bureau of Investigation (CBI) against Jagan Mohan Reddy and 73 other individuals. The allegations involve purported quid pro quo investments made in Reddy’s companies, suggesting a nexus between government favours and corporate investments.

The inquiry has focused on how substantial investments were channelled into Jagan and his family’s businesses, allegedly in exchange for favours granted by the Andhra Pradesh government during the tenure of his late father, Y S Rajasekhara Reddy.

Details of Prosecution Complaints Filed

Between 2016 and 2021, the ED submitted nine prosecution complaints against Jagan Mohan Reddy and others to the Special Court for CBI cases. These complaints have all been acknowledged by the court; however, they are still pending due to ongoing discharge petitions that have delayed further proceedings, as stated by the ED in a release.

The agency has expressed concerns regarding the lack of progress, noting that considerable time has elapsed since the courts took cognizance of the nine complaints. Despite hearing the discharge petitions, the Special Court has not yet reached a decision, impacted by factors including the transfer of presiding judges.

The ED emphasised its right to a speedy trial under Article 21 of the Constitution and has urged the Telangana High Court to facilitate the expeditious operation of the judicial process. According to the agency, the proceedings in these matters have advanced at an unacceptably slow pace for nearly a decade.

Allegations of Quid Pro Quo Investments

The ED investigation raises serious claims regarding substantial financial contributions made by various corporations and individuals, reportedly through the purchase of shares at inflated prices in companies associated with Jagan and his family. These companies include Bharati Cement Corporation Pvt Ltd, Jagati Publications Ltd, and Janai Infrastructure Pvt Ltd.

The agency’s findings suggest that these investments were part of a broader scheme to secure preferential treatment from the Andhra Pradesh government, which falls under scrutiny due to its alleged links to favourable government policies during Jagan Mohan Reddy’s father’s administration.

In its petition, the ED invoked the principle of justice, asserting that conducting a fast-tracked trial is vital for accountability. As the investigations have persisted for nearly ten years, the ED is pressing for immediate attention from the judiciary to advance the legal proceedings.
