ED Raids 15 Locations in Kolkata Linked to Durga Puja Money Laundering Case

The CSR Journal Magazine

The Enforcement Directorate (ED) conducted a series of search and seizure operations at 15 locations across Kolkata on September 29, as part of a money laundering investigation related to purported financial irregularities in the oversight of Durga Puja “Preview Shows” organised by the Mahanirban Road Mass Art (MassArt) Society. These operations were executed under Section 17 of the Prevention of Money Laundering Act (PMLA), 2002.

The premises involved include both residential and office spaces linked to the MassArt Society, its office bearers, as well as individuals associated with the organisation. Notably, locations connected to Indranil Sen, a former Minister of State in West Bengal, were also among those searched.

The ED’s searches are reflective of a broader inquiry into the financial activities surrounding these cultural events, suggesting a focus on potential mismanagement and unlawful activities.

Investigation Originating from Police FIR

The investigation spearheaded by the ED was initiated following an FIR filed at Bowbazar Police Station, which falls under the Kolkata Police Commissionerate. The FIR cites multiple provisions from the Bharatiya Nyaya Sanhita (BNS), 2023, specifically mentioning Sections 316(2), 318(4), 336(2), 336(3), 338, 340(2), and 61(2).

This case emerged after Jaydeep Mukherjee lodged a formal complaint against Indranil Sen, alongside Madhuchhanda Sen, the president of the MassArt Society. The complaint also mentions Dhrubajyoti Bose, and it includes allegations relating to the financial dealings and management practices linked to the MassArt Society’s Durga Puja Preview Shows.

The ED is focused on examining these allegations closely as part of its ongoing investigation, which seeks to uncover the intricacies of the financial operations tied to these cultural events.

Understanding Durga Puja Preview Shows

Durga Puja stands as one of the most significant annual cultural festivals in West Bengal, with numerous community and neighbourhood committees orchestrating elaborate celebrations throughout Kolkata and its surrounding areas. In the lead-up to the main event, many organisers and cultural bodies host preview exhibitions. These events are designed to showcase the intricate installations, themes, and artistic expressions that will feature during the main festival.

The preview shows are essential, as they attract public interest, sponsorship, and various forms of financial support, playing a crucial role in the festival’s overall success. The MassArt Society has actively participated in the organisation of these preview events, which are now under scrutiny by the ED in connection with alleged financial irregularities.

The ongoing investigation is set to look into the flow of funds and the financial records associated with the MassArt Society’s management of the Durga Puja Preview Shows. The ED’s latest actions signify the agency’s commitment to ensuring transparency and accountability within these significant cultural activities.

Legal Framework for ED Searches

Under Section 17 of the PMLA, the ED is authorised to carry out searches when it believes that evidence pertinent to a money laundering investigation may be located at specified locations. This provision also permits the seizure of documents and materials relevant to the investigation, while adhering to established legal safeguards.

While the ED has not made comprehensive details public regarding the materials recovered during the searches on September 29, the agency’s investigation remains active. Further actions and decisions will be guided by the findings derived from the documents and materials examined during these extensive searches.

This latest operation aligns with the ED’s ongoing efforts to scrutinise the financial dimensions of the case, following the initial FIR registered by the Kolkata Police, as it aims to clarify the relationships and transactions involved in the MassArt Society’s operations regarding the Durga Puja events.
