Maharashtra Businessman Claims Rs 1.2 Crore Fraud by Gurugram-Based company

The CSR Journal Magazine

A businessman from Chhatrapati Sambhajinagar in Maharashtra has been reportedly defrauded of over Rs 1 crore by a Gurugram-based company named ‘Tesla’, which is unrelated to the well-known automotive firm owned by Elon Musk. The incident traces back to October 2021, when Atul Narayan Paygavhan, the owner of AP Enterprises, formed a partnership with this Gurugram entity to engage in business related to batteries, inverters, and solar panels across Maharashtra and Goa.

As part of their agreement, Paygavhan deposited Rs 1 crore as a security deposit, which was to yield a return of 6 per cent along with a commission of 3.75 per cent on sales. Initial operations appeared to be successful, and a warehouse was established in Karodi village, Maharashtra, to facilitate business activities. However, the partnership reportedly began to face challenges as sales dwindled. By December 2024, both parties mutually agreed to dissolve the partnership, leading to Paygavhan returning any unutilised stock to the Gurugram-based company.

Allegations of Fraud

According to a First Information Report (FIR) lodged by Paygavhan, the company ‘Tesla’ had allegedly assured him that the security deposit, along with any outstanding commissions and the value of the returned stock, amounting to Rs 1,22,12,848, would be refunded by March 2025. However, when the specified deadline arrived without any funds being transferred, Paygavhan took the step of filing a police complaint against the managing directors of ‘Tesla’, Kavinder Khurana and Vritika Khurana.

Authorities have indicated that the accused may have engaged in deceptive practices. Reports suggest that in September, the company changed its name from “Tesla Power USA Inc.” to “Tesla Power India Limited”. This alteration is suspected to have been executed for the purpose of obtaining tax exemptions, raising concerns about the legitimacy of their operations.

The police are investigating whether this name change was a strategic move to misappropriate the funds belonging to Paygavhan and to evade any legal repercussions that might arise from their dealings. The investigation aims to uncover the full extent of the alleged fraud and the motivations behind the company’s actions.

Current Developments and Legal Proceedings

The case has garnered attention due to the significant amount of money involved and the implications of corporate fraud. As investigations continue, law enforcement officials are working to gather evidence and establish a clearer picture of the situation. The police are also scrutinising the financial records of ‘Tesla’ to ascertain the flow of funds and any potential irregularities in their business practices.

Paygavhan, who is 51 years old, has expressed his concerns regarding the handling of the case and is reportedly eager for a resolution. The outcome of this investigation could have broader implications for business practices in the region, particularly concerning partnerships and financial agreements between companies.

The situation remains fluid, with updates expected as the police delve deeper into the allegations. Stakeholders in the business community are monitoring the developments closely, as this case highlights the risks associated with partnerships and the importance of due diligence in financial transactions.
