Delhi High Court Bar Association Criticizes Police Protest Response

The CSR Journal Magazine

The Delhi High Court Bar Association (DHCBA) has condemned the detention of numerous lawyers, citing what it described as excessive police force during a peaceful protest against Chief Election Commissioner Gyanesh Kumar. This protest was organised in response to allegations of voter-list manipulation during the Special Intensive Revision of the electoral roll.

Reports indicate that the protests involved many lawyers, including female advocates, who voiced their concerns regarding the electoral process. The situation escalated when police intervened, leading to the alleged use of physical force against these legal professionals. The DHCBA’s resolution highlighted the need for accountability in such actions, urging a thorough inquiry into the incident.

In the resolution, which was signed by the DHCBA president, senior advocate N Hariharan, and honorary secretary Vikram Singh Panwar, the association denounced the treatment of its members. It stated that video evidence showed lawyers being forcibly removed by police, emphasising that this behaviour is unacceptable and undermines the dignity of the legal profession.

Demands for Accountability and Inquiry

The DHCBA has called for an impartial investigation to ascertain the events and actions taken by the police during the protest. It expressed the belief that members of the legal community should not be subjected to arbitrary detention or excessive force when exercising their right to peaceful assembly and dissent.

Additionally, the association addressed alarming reports of police personnel allegedly tearing up the Preamble of the Constitution during the protest. The DHCBA remarked that such actions undermine the foundational principles of the Republic and call into question the respect for constitutional rights.

The resolution underscored that maintaining public order should never serve as an excuse for the misuse of power against individuals lawfully expressing their views. The concerns raised by the DHCBA align with broader discussions on civil liberties and the role of law enforcement in democratic societies.

Background of the Protest

The protest, orchestrated by the Cockroach Janta Party, focused on claims against Chief Election Commissioner Gyanesh Kumar regarding voter registration practices. The demonstration was particularly aimed at advocating for transparency in the electoral process, especially relating to Form 6, which is essential for voter registration.

With growing concerns about electoral integrity, the DHCBA’s resolution reflects an urgent call for attention to these issues, particularly from those within the legal field. The association’s demands indicate a pivotal moment for both legal professionals and the electoral process in India, highlighting the intersection of law and democracy.

The events of the protest serve as a reminder of the crucial balance between maintaining order and protecting individual rights within a democratic framework. The DHCBA’s commitment to safeguarding these principles showcases its role as a key advocate for both legal professionals and broader civil rights.
