Delhi HC Requests Sourav Ganguly to Identify Objectionable Scenes in ‘Doosra’

The CSR Journal Magazine

The Delhi High Court has requested cricketer Sourav Ganguly to pinpoint specific segments of the film ‘Doosra’ that allegedly infringe upon his personality rights. This directive was issued on Thursday by Justice Tejas Karia, who is overseeing the case. The court has also instructed the defendants to provide a pen drive containing the film for review.

The hearing for Ganguly’s lawsuit against the film’s producers is scheduled for November 2. The film is characterised as a fictional narrative centred around a middle-class Rajasthani girl, drawing inspiration from events related to Ganguly’s career. The court has asked for a detailed table that includes timestamps of the contested scenes along with a description of the objections raised by Ganguly.

Plaintiffs Raise Concerns Over Contractual Rights

Luv Films LLP, which is producing a biopic titled ‘Dada’ about Ganguly, is also a plaintiff in this case. The company has claimed that ‘Doosra’ violates its contractual rights. In light of this, the court has requested that the plaintiffs submit the manuscript of their upcoming film in a sealed envelope. The plaintiffs are required to clarify how the defendants’ film allegedly breaches these rights.

The plaintiffs’ legal counsel has sought a temporary injunction against the defendants, despite the fact that ‘Doosra’ was released in theatres last week. It was noted during the proceedings that the film has not yet been made available on streaming platforms. The counsel argued that the film exploits Ganguly’s image without his consent, stating, “It is all about Sourav Ganguly’s life. After intermission, it is all about the 2002 NatWest match.”

In response, a senior counsel representing the defendants asserted that they had obtained the necessary permissions from the authorities who hold the copyright for the clips used in the film. The defendants contended that Ganguly was merely a “source of inspiration” for the storyline, thus challenging the basis of his objections.

‘Doosra’ and Legal Proceedings

On October 23, the High Court had previously instructed the makers of ‘Doosra’ to respond to Ganguly’s allegations regarding the violation of his personality rights. The court also mandated that a screening of the film be arranged. A day prior, the court had declined to halt the film’s theatrical release, indicating that the legal proceedings were ongoing.

‘Doosra: India’s Other Freedom Struggle’ is a sports drama directed by Abhinay Deo. The film features actors Plabita Borthakur, Ankur Vikal, and Samidha Guru. As the case progresses, the court will examine the scenes identified by Ganguly alongside the claims related to his personality and contractual rights.

The upcoming hearing on November 2 will be pivotal in determining the next steps in this legal dispute. Both parties are expected to present their arguments regarding the film’s content and the implications for Ganguly’s public persona.
