Bhopal Court Extends Judicial Custody of Samarth Singh and Giribala Singh Till June 30

The CSR Journal Magazine

The Bhopal Court has extended the judicial custody of Samarth Singh and his mother, Giribala Singh, until June 30. This decision follows a request from the Central Bureau of Investigation (CBI) during a hearing on June 16, after the conclusion of their 14-day judicial custody. The accused appeared before the court via video conferencing.

During the proceedings, the CBI argued that further remand was necessary for the ongoing investigation into the alleged dowry harassment and the subsequent death of Twisha Sharma. The court accepted the CBI’s request and granted an additional 14-day period for their custody.

Previously, on June 2, both Samarth and Giribala Singh were presented in court following a five-day custodial remand prior to their judicial custody. This remand was part of the CBI’s efforts to gather more facts regarding the case.

Investigation into Twisha Sharma’s Death

The case concerns the death of 33-year-old Twisha Sharma, who was found deceased at her matrimonial home in Bhopal on May 12. Reports indicate that her family has accused Samarth Singh and his in-laws of subjecting her to mental and physical harassment related to dowry demands.

In light of these serious allegations, the matter has been officially handed over to the CBI, which is actively investigating the circumstances surrounding Sharma’s death. The agency is also assessing claims made by her family regarding the treatment she allegedly endured.

This investigation falls under the jurisdiction of significant legal provisions, including the newly enacted Bharatiya Nyaya Sanhita, 2023, and the Dowry Prohibition Act, 1961. The CBI is expected to take a thorough approach to gather evidence and testimonies related to the case.

Charges Against The Accused

Giribala Singh faces multiple charges, including those under Section 80(2) for dowry death, and Section 85 pertaining to cruelty towards a woman by her husband or relatives. Furthermore, she is implicated under Section 3(5), which addresses acts committed by several individuals in furtherance of a common intention.

In addition to these charges, Giribala Singh has also been booked under Sections 3 and 4 of the Dowry Prohibition Act. The implications of these charges highlight the seriousness of the allegations made against the accused individuals.

The investigation remains ongoing as the CBI seeks to clarify the relationship dynamics within the family and the events leading up to Sharma’s tragic demise. This comprehensive examination aims to address the claims of harassment and ensure accountability as per the law.
