7-Year-Old Canadian Girl And Mother Detained By ICE Despite Valid Legal Status Till 2030

A seven-year-old child from British Columbia, Ayla Luca, has been apprehended by U.S. Immigration and Customs Enforcement (ICE) along with her mother, Tania Warner. They have reportedly been taken to a detention facility in Texas, where family members claim they were informed that release is contingent upon self-deportation. The child has been diagnosed with autism and has lived in the United States for five years following her mother’s marriage to Edward Warner, a U.S. citizen.

Edward Warner stated that the family possesses legal documentation that remains valid until the year 2030. According to him, the situation has caused significant distress for Tania, who communicated in hushed tones during phone conversations to avoid detection by officials. He expressed concern over Tania’s emotional state, asserting, “She says she’s traumatized… They’re not good.” Edward also mentioned that Ayla developed a rash while in detention.

Encounter with Border Patrol

The family, residing in Kingsville, Texas, was halted at a border patrol checkpoint in Sarita while returning home from a baby shower in Raymondville on March 14. Tania’s cousin, Amber Sinclair, disclosed that Tania possesses a social security card and holds a valid visa. The family is currently seeking funds to secure legal representation.

Political Response and Community Support

Vicente Gonzalez, a Democratic congressman representing Texas’s 34th congressional district, issued a statement indicating that his office is advocating for the family’s release. He emphasized Tania’s essential role within the Kingsville community and underscored that both she and Ayla should not be subjected to detention. Gonzalez stated, “We must bring them home and reunite yet another family being ripped apart by this Administration’s rogue immigration enforcement operations.”

Current Detention Conditions

Tania and Ayla were initially processed at the Rio Grande Valley Central Processing Center in McAllen, Texas, but were later transferred to the Dilley Immigration Processing Center in South Texas. The facility has garnered a negative reputation due to reports of disease outbreaks and inadequate medical care. Originally opened during the Obama administration, it was closed under Biden’s presidency but reopened in early 2025 for the purpose of holding families together.

Government Awareness and Consular Support

Global Affairs Canada, responsible for consular services and international relations, acknowledged on Thursday that it is aware of several Canadians presently or previously detained for immigration reasons in the United States. A representative mentioned that consular officials advocate for Canadian citizens overseas and communicate issues regarding potential mistreatment or discrimination to local authorities. However, they clarified that officials cannot exempt Canadians from legal proceedings in the U.S. Due to privacy regulations, no additional details are available on specific cases.
