Vijay Deverakonda Seeks Personality Rights Protection in Delhi High Court

The CSR Journal Magazine

Vijay Deverakonda has approached the Delhi High Court in an effort to safeguard his personality and publicity rights. The actor alleges that his name, image, and other aspects of his persona have been misused without consent, leading to instances of fake endorsements and impersonation. This legal action highlights the growing concerns among public figures regarding the misuse of their identities.

Court Hearing and Allegations of Impersonation

The petition was heard briefly by Justice Vikas Mahajan, who indicated that the court would make a decision regarding Deverakonda’s request for an interim injunction. Senior Advocate Swathi Sukumar, representing the actor, informed the court about the distress caused by the unauthorised endorsements and impersonation, emphasising that multiple individuals have reportedly acted as representatives of Deverakonda against his wishes.

Sukumar also brought to the court’s attention the alleged commercial exploitation of the actor’s identity, including merchandise featuring his image and other elements of his persona. The concerns extend to the use of artificial intelligence and digital manipulation in the production of content that utilizes Deverakonda’s photographs, which have raised issues of authenticity and consent.

Additionally, the plea addresses the existence of material deemed obscene and offensive, including language that could be considered abusive, in connection with Deverakonda’s persona. Since the filing of the suit, some URLs associated with the allegedly misleading content have reportedly been taken down, according to the actor’s legal counsel.

Legal Context and Previous Cases

The Delhi High Court has issued summons concerning the suit and notice regarding the interim injunction request. This legal development occurs within a broader trend of litigation in India concerning the protection of personality and publicity rights for various public figures, including actors and athletes. Several notable cases have been heard by the court, highlighting the importance of safeguarding identities in the digital age.

In previous rulings, the Delhi High Court has granted protection to other celebrities, such as Amitabh Bachchan, who received judicial support against unauthorised exploitation of his name, image, and voice. Similarly, Anil Kapoor has also had his personality rights protected. The court has been involved in numerous cases representing a variety of prominent figures, including actors like Tabu, Rajinikanth, and Kajol Devgan, among others.

Not only actors, but the court has also addressed personality-rights claims from well-known cricketers, including Yuvraj Singh and Sunil Gavaskar. Additionally, musicians such as Arijit Singh and Sonu Nigam have sought similar protections, reflecting the widespread nature of this issue among celebrities.

Growing Concern Over Digital Misuse

The rise of technology, particularly in the realm of digital content creation, has led to increased scrutiny regarding the unauthorised use of personal identities. With the advent of AI-generated content, the challenges faced by public figures are evolving. Deverakonda’s case underscores the delicate balance between public life and personal rights in an environment where digital manipulation is commonplace.

The outcome of this case could have implications for future legal standards regarding personality rights in India. As the court considers Deverakonda’s plea, it is likely to influence how similar cases are adjudicated in the future, shaping the landscape of personality rights protection for public figures.
