Kartik Aaryan Seeks Legal Protection for Personality Rights

Kartik Aaryan has initiated legal proceedings in the Bombay High Court to safeguard his personality rights against what he claims is the unauthorised use of his image and likeness in commercial activities. The actor’s suit, which falls under the category of commercial intellectual property, targets various domestic and international e-commerce outlets and social media platforms, along with unidentified defendants referred to as “John Doe.”

The legal action arises from allegations that Aaryan’s name, photographs, and other personal attributes are being exploited without his consent in advertisements and merchandise across digital platforms. This purported misuse infringes upon his rights to publicity and privacy.

In the suit, Aaryan seeks a permanent injunction to prevent the defendants from continuing to utilise his visual and auditory likeness for commercial gain. This includes potential uses of his persona through artificial intelligence technologies and deepfake methods, which have raised significant concerns regarding authenticity and consent in the digital age.

Demands for Action from Platforms and Authorities

Aaryan’s plea includes requests for online intermediary platforms and relevant government authorities to take prompt action in removing any infringing content that exploits his personality. Additionally, he is asking for the disclosure of the identities of those who have allegedly committed these acts of infringement, aiming to hold the offenders accountable.

The legal proceedings have been scheduled for a hearing on April 9, where senior advocate Birendra Saraf is set to represent Aaryan. He will be supported by advocates Ameet Naik and Madhu Gadodia, who will seek interim relief for the actor during this session.

The involvement of these senior legal professionals suggests the seriousness of the case and Aaryan’s intent to robustly defend his rights amid growing complexities in the digital landscape.
