FSSAI Takes Legal Action Against Nestlé India Over Infant Nutrition Products

The Food Safety and Standards Authority of India (FSSAI) has launched legal proceedings against Nestlé India Ltd for purported infringements of food safety laws regarding its infant nutrition offerings. The announcement, made on September 18, highlights concerns about promotional statements associated with the products NAN Excella Pro Stage 1 and Lactogen Pro 1, as well as a follow-up formula. Laboratory tests indicated that these products contained Biotin levels below the prescribed standards.

The FSSAI’s investigation included a thorough review of the products and associated advertising available on e-commerce platforms. The authority detected certain promotional claims that were allegedly misleading. Specifically, claims for the NAN Excella Pro Stage 1 indicated the presence of “5 HMOs” and “Whey Protein,” while for Lactogen Pro 1, it was asserted that “Whey Protein” is easy to digest.

Furthermore, the FSSAI has requested clarification from Nestlé India regarding these promotional claims. The regulator points out that both products allegedly contravene Regulation 4(2) of the Foods for Infant Nutrition Regulations, 2020, which prohibits promotional claims aimed at boosting the sales of infant foods. This regulatory framework is designed to protect the health of infants by ensuring that marketing efforts do not mislead caregivers.

Legal Provisions Cited by FSSAI

In addition to the above, the FSSAI has cited violations of Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods Act, 1992. This law expressly forbids advertising and promoting infant food products. According to the FSSAI, the actions taken against Nestlé India reflect a commitment to enforcing these protections in the interests of public health and safety.

In a separate finding, a sample of the Follow-up Formula produced by Nestlé India was assessed and discovered to be below standards for Biotin content. Following this, the product sample was forwarded to a Referral Laboratory for further analysis. The subsequent tests failed to meet the stipulated Biotin levels as defined in the relevant regulations.

In light of these infringements, FSSAI has initiated three distinct adjudication cases against Nestlé India concerning the three mentioned products. This legal action underscores the regulatory body’s diligence in adhering to the guidelines set forth for the safety of infant nutrition products.

Impact on Nestlé India’s Stock Performance

As the news broke, it was reported that shares of Nestlé India were trading at approximately Rs 1,347 each, marking a decline of Rs 25 or 1.82 per cent from the previous closing price of Rs 1,372. The drop in share price reflects market concerns regarding the potential ramifications of these regulatory actions on the company’s reputation and sales in the competitive infant nutrition sector.

The legal proceedings initiated by FSSAI may have long-term implications for Nestlé India, particularly if further compliance issues arise during the adjudication process. The company will likely be under public and investor scrutiny as considerations regarding product quality and regulatory adherence come to the fore.

While Nestlé India has yet to publicly respond to the FSSAI’s claims, industry analysts will be closely monitoring developments in this case, as they may influence future marketing and product strategies within the company and the broader industry context.
