The Delhi High Court has consented to conduct an urgent hearing regarding a petition that claims significant breaches of the Lyngdoh Committee recommendations during the ongoing Delhi University Students’ Union (DUSU) election campaign. The petition alleges that the guidelines aimed at ensuring fair elections have not been adhered to, prompting concerns over the integrity of the electoral process.

This plea was filed by advocate Prashant Manchanda and brings attention to the need for strict enforcement of election norms. Specifically, it requests the disqualification of candidates and their supporters if they are found to have violated the established regulations. The urgency of this application is accentuated by the fact that DUSU elections are scheduled for tomorrow.

During the proceedings, the petitioner highlighted alarming incidents of vandalism and other violations on university campuses, leading to a chaotic atmosphere that could disrupt the electoral process. Legal representatives emphasised the urgency for immediate action to address these allegations effectively.

The petition points out several reports of violations, including the presence of large groups of supporters and outsiders accompanying candidates, which contravenes the guidelines that restrict candidate support to four bona fide students residing on campus. This alleged misuse is seen as a critical issue that undermines the principles of fairness in the election process.

Additionally, the applicant has raised concerns over the use of vehicles, roadshows, and rallies that have led to traffic disruptions in and around university areas. Such actions not only violate campaign norms but also raise concerns about public safety and order, as defined by previous judicial interventions.

Furthermore, the use of printed materials, such as posters and pamphlets, has been cited as another area of violation. The applicable election rules specify that only handmade posters are permitted, yet there have been extensive reports of candidates using printed materials, along with variations in candidates’ names on campaign materials through spelling alterations.

Request for Strict Enforcement of Guidelines

The plea requests urgent action from authorities to implement the Anti-Defacement Guidelines and the DUSU Code of Conduct. It also calls for adherence to the Lyngdoh Committee recommendations, alongside binding directions made by both the High Court and the Supreme Court regarding the elections.

In light of previous judicial interventions aimed at curbing electoral malpractices, the petition contends that recurring violations necessitate immediate preventive action to preserve the integrity of the election. Failure to address these issues could lead to further complications affecting both public safety and the law-and-order situation during the DUSU elections.

The ongoing hearing serves as a critical juncture for upholding electoral guidelines and ensuring that the democratic process within university campuses is maintained without disruptions. The court’s decision on these matters will be pivotal in determining the conduct of the elections and the enforcement of existing regulations.
