Anish Gawande Criticises Arrests of CJP Leaders and Calls for Protests

The CSR Journal Magazine

Anish Gawande, the spokesperson for the Nationalist Congress Party (Sharad Pawar faction), has condemned the recent arrests of Citizens for Justice and Peace (CJP) leaders Saurav Das and Ashutosh Ranka. He referred to the preventive arrests as ‘bizarre’ and questioned the legal basis for the actions taken against them. Gawande’s remarks come in the wake of the leaders’ detention after they allegedly breached barricades at Jantar Mantar, a site recently denotified for protests.

The police reportedly Das and Ranka early on Tuesday while raising slogans demanding the resignation of Chief Election Commissioner Gyanesh Kumar. The police have filed charges against them, which include trespassing, violating prohibitory orders, breaching a peace bond, and obstructing a public servant. Gawande has expressed concern over the implications of such arrests for democratic rights in India.

In his statement, Gawande questioned the legitimacy of the FIR filed against the CJP leaders, particularly in light of the involvement of the Janata Dal (United) in the complaint. He challenged Bihar Chief Minister Nitish Kumar to clarify his stance on the matter, particularly given his historical background in student politics and the JP movement.

INDIA Bloc Prepared for Further Protests

Gawande revealed that Rahul Gandhi has instructed the INDIA bloc to be prepared for protests on short notice, indicating a strategic response to the ongoing situation. The bloc is reportedly seeking intervention from the Supreme Court regarding the arrests and broader concerns related to the Election Commission’s operations.

The spokesperson highlighted that the bloc aims to address what he described as an illegal FIR, alleged police brutality, and issues surrounding the functioning of the Election Commission. He noted that the arrests follow protests by CJP and other organisations, which have raised concerns about irregularities in the Special Intensive Revision (SIR) of electoral rolls.

Gawande’s comments reflect a growing tension between political parties and law enforcement, particularly regarding the treatment of protesters. He emphasised the importance of maintaining the right to dissent, especially in a democratic society.

Changes to Approved Protest Sites Raise Concerns

The recent arrests and subsequent protests have been complicated by a decision made by the Delhi Police Commissioner Anurag Kumar on October 11. The commissioner designated Ramlila Maidan, Burari Ground, and CBD Ground as the only approved venues for demonstrations, effectively removing Jantar Mantar from the list. This change has raised alarms among activists who argue that relocating protests away from the political centre diminishes their visibility and impact.

CJP has voiced concerns that such restrictions on protest locations limit the ability of citizens to express dissent in a meaningful way. The organisation argues that the political significance of Jantar Mantar as a protest site has historically provided a platform for voices of dissent in the heart of the capital.

As the situation develops, the INDIA bloc and CJP are likely to continue their advocacy for the rights of protesters and the integrity of the electoral process. The upcoming actions will likely depend on the responses from both the Supreme Court and the Bihar government regarding the recent arrests and the broader implications for democratic engagement in India.
