Youth Congress President Uday Bhanu Chib Sent to Judicial Custody in AI Summit Protest Case

The CSR Journal Magazine

The Patiala House Court has placed Uday Bhanu Chib, President of the Indian Youth Congress (IYC), in judicial custody concerning the AI Summit protest case, even after he was granted bail earlier on the same day. Judicial Magistrate First Class Vanshika Mehta mandated the verification of the bail bond and supporting documents before Chib’s potential release. A verification report is expected by Sunday, and the court will not allow his release until the authenticity of the surety and related papers is confirmed.

Midnight Hearing After Four-Day Police Custody

Chib was presented in court shortly after midnight, following the conclusion of his four-day police custody. The court granted bail on the condition that he submits a bond of Rs 50,000 along with additional requirements, including the surrender of his passport and any electronic devices to the authorities. Notably, the Delhi Police Crime Branch had requested an extension of Chib’s police custody by another seven days. However, this request was denied by the court, which pointed out that the prosecution did not provide sufficient justification for further remand.

Defense Comments on the Hearing Process

Advocate Mohammed Sulaiman, representing Chib, remarked that the court recognized that the police failed to substantiate the necessity for an extended custody. He emphasized that while bail was granted, specific conditions were imposed, including a surety of Rs 50,000. Advocate Rupesh Singh Bhadauria added that Chib’s arrest was not a new development, as he had already been in police custody for four days. Bhadauria indicated that they received notification about Chib’s court appearance around midnight, which caused a degree of panic, but expressed relief that they at least received some communication regarding him, unlike the situation for other accused individuals.

Details of the Arrest and Initial Custody

Uday Bhanu Chib was detained by the Delhi Police on the morning of February 24 in connection with the protests related to the AI Summit. During earlier court proceedings, it was noted that while Chib was allegedly not physically present at the protest site, he was purportedly directing activities and communicating with other individuals involved. The earlier remand order also suggested that allegations related to sovereignty compromise do not justify long-term custody. The court had previously observed that prolonging police custody to seven days was excessive, and that a four-day period was adequate, stressing that the investigating agency needed to rationalize the necessity for custodial interrogation.
