Supreme Court of India Rejects Plea for Nationwide Ban on Mosques Named After Babur

The Supreme Court of India dismissed a petition on Friday that sought to impose restrictions on the construction of mosques named after Mughal emperor Babur. The plea argued that any mosque named after Babur, including the Babri Masjid, should not be built across the country, citing the historical context of Babur as an anti-Hindu invader. A bench comprising Justices Vikram Nath and Sandeep Mehta delivered the ruling after considering brief arguments presented by the petitioner.

Concerns Raised Over Construction in Murshidabad

During the court proceedings, the petitioner’s counsel highlighted ongoing construction efforts for a mosque in Murshidabad, also referred to as Babri Masjid. The counsel emphasized that this construction was controversial due to Babur’s character as described in the petition. This development follows the foundation stone-laying event led by Humayun Kabir, chief of the Jan Unnayan Party and former MLA from the Trinamool Congress, on December 6, 2025. Kabir publicly declared that the mosque would be built regardless of opposition, given the substantial Muslim population in West Bengal, which he stated stands at 37 percent.

Legal Justifications for Mosque Construction

In defense of the construction, Kabir pointed out the constitutional rights that permit the establishment of places of worship. He argued that just as temples and churches can be built by various communities, so too can mosques be erected. He expressed confidence that legal challenges would not hinder the mosque’s development. Kabir cited his strong belief in divine support, asserting that no legal actions could dissuade him from his plans. “The court has made it clear that the Constitution of India guarantees the right to construct a mosque,” he remarked.

Plans for Additional Community Infrastructure

On January 2, Kabir announced further plans for the Murshidabad area, indicating that the site would not only feature the Babri Masjid but also include a hospital and a university. He mentioned at a public gathering that these initiatives aim to enhance community welfare. Kabir’s remarks underscored his commitment to developing infrastructure that would benefit local residents, alongside the mosque project.
