SCAORA Supports CJI, Advocates Court Process for Political Grievances

The CSR Journal Magazine

The Supreme Court Advocates-on-Record Association (SCAORA) has expressed its backing for Chief Justice of India Surya Kant’s assertion that political parties should seek judicial remedies for their issues. This statement highlights the necessity for respecting the independence of the judiciary in all political processes.

SCAORA, in a formal resolution, reiterated its dedication to maintaining this independence, asserting that grievances should be addressed through the appropriate legal avenues. According to SCAORA, it is vital that every mechanism for resolving disputes is pursued through lawful channels. The association emphasised that any attempts to bypass the judicial process could impede court operations and undermine fair justice delivery.

Their resolution made it clear that such practices violate the foundational principles of the legal system. The text of the resolution noted, “SCAORA appreciates the stand taken by the Chief Justice of India,” mentioning that political parties must approach the court for grievance resolutions as mandated by the law. This serves as a reminder that legal recourse exists to address any issues raised by such organisations.

CJI’s Response to Political Leaders

On Monday, Chief Justice Surya Kant addressed a communication from Leader of Opposition Rahul Gandhi and Congress President Mallikarjun Kharge. He declined their request for a meeting, stating that discussing pending matters before the Supreme Court would contravene the principles of separation of powers. This correspondence comes amid concerns raised by the Congress regarding various issues impacting their political activities.

Justice Kant’s letter, which specified that any meeting on sub judice topics was “incompatible with established ethics and judicial propriety,” was significant in clarifying the judiciary’s role. He urged the political leaders to submit their concerns through formal petitions, either in person or online, rather than seeking direct dialogue with the judiciary.

The letter was a direct response to Kharge and Gandhi’s previous correspondence dated October 10, in which they requested a meeting on October 12. Their petition outlined various issues, including concerns related to the Chief Election Commissioner, activities of the Election Commission of India, and the alleged wrongful arrests of students amid public protests in Delhi.

Importance of Judicial Channels

The exchange between the political leaders and the Chief Justice underlines a critical point about the importance of using judicial channels to address grievances. SCAORA’s resolution strengthens this message, insisting that issues must be raised in a structured legal context. This further highlights the necessity of adhering to established judicial protocols when seeking justice.

Furthermore, SCAORA has made it clear that actions obstructing the judicial system, or those affecting the independence of justice, are unacceptable. The association’s stance reflects a broader commitment to safeguarding the integrity of the judiciary from external pressures, particularly political ones.

In summary, SCAORA and Chief Justice Surya Kant have both underscored the imperative that all grievances, particularly those from political entities, must follow the legal process. This ensures that every issue is addressed systematically and fairly, maintaining the rule of law as foundational in India’s democratic framework.
