Muzaffarpur Man Declares 90-Year-Old Father Dead, Illegally Sells Ancestral Land

A deeply distressing case has come to light from Mahmadpur village in Bihar’s Muzaffarpur district. A 90-year-old man, Raj Narayan Thakur, approached the District Magistrate on Saturday seeking justice. This comes after discovering that he had been falsely declared dead by his own son to illegally sell ancestral property.

With a walking stick in hand and hope in his heart, Mr. Thakur knocked on the doors of the district administration, pleading for the cancellation of the fraudulent land transfer and legal action against those responsible.

Declared Dead While Still Alive

According to the written complaint submitted by Mr. Thakur, his fifth son, 44-year-old Dilip Thakur, sold a portion of their ancestral land for Rs 2 lakh by forging documents that falsely claimed his father was deceased. The land in question is still registered in the name of Mr. Thakur’s late father, Methura Thakur, and has not yet been formally divided among Mr. Thakur and his two brothers, Ramjinish and Rampukar.

“He (Dilip) sold this land for Rs 2 lakh at the Motipur Registry Office by declaring me dead in the land records, despite me being alive and no physical land verification was done by the registry office, Motipur. This fraudulent activity has been carried out without my knowledge, consent, or any legal authority, causing me immense mental distress and financial loss,” the complainant said.

“There has only been a verbal understanding regarding the separation of land. No legal demarcation has ever taken place, and the land continues to be recorded under my father’s name,” Mr. Thakur stated in his petition.

Sale Without Consent, Verification Ignored

Despite the lack of formal ownership and Mr. Thakur being alive, Dilip allegedly went ahead with the sale. The sale deed, which the elderly man presented to the authorities, shows a transaction between Dilip Thakur and a buyer named Suman Saurabh, registered at the Motipur Registry Office. Shockingly, Mr. Thakur’s death was falsely declared in official documents, and no physical verification of the land was conducted prior to registration.

“This fraudulent act has caused me immense mental distress and financial harm,” said Mr. Thakur. “I was neither informed nor did I give any consent for this sale.”

Family Dispute and Allegations of Misconduct

Mr. Thakur also revealed that his son has a history of selling off family property due to his alleged alcoholism and irresponsible behavior. He expressed heartbreak over the family’s treatment of him, saying no one checks on his well-being or provides for his basic needs like food or clothing.

“I only want justice and the rightful protection of my share in the ancestral property,” he added with emotion.

District Magistrate Orders Inquiry

Taking note of the seriousness of the allegations, District Magistrate Subrat Kumar Sen has ordered a detailed investigation into the matter. Instructions have been issued to both the local Circle Officer and the Station House Officer to verify the claims and take necessary action.

The DM also indicated that the registry documents do indeed show the sale was carried out under Dilip Thakur’s name. He acknowledged that Mr. Thakur’s other son and grandson had accompanied him during the plea, demonstrating broader family support for the investigation.

Legal Route If No Family Resolution

Local authorities have advised that the dispute could potentially be resolved through mutual understanding between the brothers. However, if no agreement is reached, a formal partition suit may be filed in court.

DM Sen emphasized that efforts will first be made to settle the issue locally and amicably, but legal proceedings will follow if necessary.
