Kerala Government To Register FIR in CMRL Bribery Case

The Kerala government is set to request the Vigilance and Anti-Corruption Bureau to file a First Information Report (FIR) concerning the alleged bribery case involving the Leader of Opposition in the Kerala Assembly, Pinarayi Vijayan, and his family members. This decision comes after a directive from the Kerala High Court, which ordered the state to proceed with the registration based on a report from the Enforcement Directorate (ED) submitted to the police.

On Friday, the High Court determined that a preliminary inquiry was unnecessary, thereby allowing for the filing of a formal case. The ED has claimed that Cochin Minerals and Rutile Limited (CMRL) allegedly made illicit payments related to Vijayan, his daughter Veena T, and his son-in-law, P A Muhammad Riyas, who is also a Member of the Legislative Assembly (MLA).

Ramesh Chennithala, while addressing the media on Saturday, confirmed the government’s intent to comply with the court’s ruling. He stated that the Vigilance and Anti-Corruption Bureau will be instructed to file the FIR on Monday, emphasising the government’s respect for the legal process and the court’s judgement.

Allegations of Fraudulent Payments

The Enforcement Directorate alleges that CMRL made fraudulent payments amounting to Rs 2.78 crore to Veena T’s now-defunct firm, Exalogic Solutions, purportedly for IT consultancy services. This accusation forms the basis for the FIR that the Kerala government intends to register, highlighting the seriousness of the allegations involved.

Chennithala noted that the government had initially sought a preliminary inquiry based on legal advice. However, he acknowledged the court’s determination that a preliminary inquiry was not essential, thereby facilitating the progression to a formal case. He affirmed that the government would follow the court’s directive without seeking to appeal against the ruling.

In response to queries regarding statements made by CPI(M) general secretary concerning the viability of the case in court, Chennithala reiterated the High Court’s stance, asserting that the ruling provides clear evidence supporting the proceedings. He highlighted that the government respects the judicial process fully, reiterating that it will act based on the directions of the court.

Political Context and Reactions

Chennithala also addressed the allegations made by the Cockroach Janta Party (CJP), which suggested a connection between the changing political landscape in Kerala and the Special Intensive Revision of electoral rolls. He categorically denied these claims, stating that the electorate had decisively ended what he described as a decade of misgovernance under Pinarayi Vijayan through their votes.

Additionally, he remarked that even candidates who faced electoral defeat did not contest the legitimacy of the election outcomes. Chennithala mentioned the ongoing political movement led by Rahul Gandhi, stating that it aims to secure the resignation of Chief Election Commissioner Gyanesh Kumar, labelling it a struggle for the preservation of Indian democracy.
