This dispute primarily revolves around personality rights associated with the 1998 blackbuck poaching case, which has become a significant point of contention in the Indian film industry.

The appeal filed by Amit Jani argues that the Delhi High Court should not have granted a directive to remove promotional material and the teaser for Kala Hiran: The Battle for Legacy without sufficient evidence demonstrating how the content infringed upon or commercially exploited the persona of actor Salman Khan. Jani’s legal team has underscored that the High Court’s restraining order poses a potential risk to artistic expression.

The appeal further posits that allowing the actor to suppress the filmmaker’s creative work under the veil of personality rights could create a detrimental chilling effect on artistic representations of matters that pertain to public interest. The court is therefore urged to consider the broader implications of the case on freedom of expression and the rights of filmmakers.
