Dubai Enacts New Building Regulation: Penalties Up to Dh2 Million for Infractions

Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, has recently signed into law a significant regulation pertaining to building quality and safety within the emirate of Dubai. This initiative, introduced as part of his role as Ruler of Dubai, seeks to ensure structural integrity, enforce regular maintenance, and facilitate the safe operation of building systems. The law aims to enhance safety, improve quality, and promote sustainability in the construction sector. Furthermore, it intends to provide greater comfort for occupants, minimize the risk of accidents, safeguard lives and property, and maintain the distinctive architectural identity of Dubai.

Provisions and Responsibilities

The new building law applies universally to all structures in Dubai, including those situated within private development zones and free zones, irrespective of their construction date. In response to the law’s enactment, the Dubai Municipality will develop a digital management system, create a comprehensive database, and carry out routine assessments. The Municipality is responsible for setting safety and quality standards, implementing protective measures for buildings and occupants, managing maintenance tasks, and regulating construction materials. A Quality and Safety Certificate will be issued only after a thorough inspection by a licensed engineering firm, confirming the building’s structural condition.

Requirements for Building Owners

Under the new regulations, building owners—including owners of individual units as defined in Law No. (6) of 2019 regarding Joint Property Ownership in Dubai—must secure a Quality and Safety Certificate upon the completion of their buildings. They are also required to rectify any deficiencies found during inspections and adhere to guidelines established by the relevant authorities. The validity of the Certificate is ten years for buildings less than 40 years old and five years for those that are 40 or older. The renewal process will be governed by a decision from the Chairman of the Executive Council of Dubai. In cases where a building is approved for demolition, established rules concerning tenant vacating procedures, as detailed in Law No. (26) of 2007, will apply. Tenants who vacate under these regulations will have priority to return after completion of reconstruction or maintenance at their original rental rates, unless a different agreement is made.

Punitive Measures for Non-Compliance

Violations of the new law may result in penalties ranging from Dh100 to Dh1,000,000. Should a violation be repeated within a two-year timeframe, fines can be increased to a maximum of Dh2,000,000. The implementation of these strict regulations contributes to Dubai’s reputation as a secure metropolis.

This new legislation is part of ongoing efforts by Sheikh Mohammed to further enhance safety and security for residents and visitors alike. Following the introduction of Law No. (2) of 2026, which aims to create a protective framework for public safety and urban development, Dubai is positioning itself as one of the safest cities globally. The recent safety measures also arise amid regional tensions, as the UAE navigates challenges posed by geopolitical factors, including Iranian aggression.
