A Delhi court has deferred the hearing regarding the sentencing of former AAP councillor Tahir Hussain along with four accomplices following their conviction for the murder of Intelligence Bureau officer Ankit Sharma. The hearing, initially set for an earlier date, will now take place on July 27. This decision came after the defence requested additional time to prepare its submissions for the sentencing phase.

Additional Sessions Judge Praveen Singh was initially hesitant to grant the extension, citing that a convict should not be left awaiting a sentence for too long. Nevertheless, he eventually acknowledged the request, emphasising that it was important for the defence to adequately present its arguments when the implications for the accused were significant.

During the court session, advocates Rajiv Mohan and Tara Narula, representing Hussain, argued for more time to formulate their points on sentencing. Although the judge resisted this at first and prompted both prosecution and defence to continue with their proceedings, he later reconsidered his stance. He mentioned that denying the request might rush the matter, depriving the accused of a fair opportunity to state their case.

Background of the Case

The court had previously convicted Hussain and four others on July 13 for the murder of Ankit Sharma, who was reportedly attacked by a mob during the 2020 northeast Delhi riots. His body was discovered in a drain, highlighting the brutal nature of the events that unfolded. The trial revealed that Hussain was allegedly part of a violent mob targeting members of the Hindu community, engaging in rioting, arson, and looting.

In its decisive verdict, the court stated that Hussain and others were involved in a “savage and relentless assault” that resulted in Sharma’s murder. The prosecution successfully established that participants of the unlawful assembly were aware that their actions could lead to fatal consequences, thus justifying the severity of the charges against them.

Hussain was convicted under multiple sections of the Indian Penal Code, including Sections 302 for murder, 365 for kidnapping, 147 and 148 for rioting, Section 153A pertaining to promoting enmity between different groups, and Section 188 for disobedience to an order duly promulgated by a public servant, in conjunction with Section 149, which addresses unlawful assembly.

The court has ordered the defence to submit affidavits detailing the socio-economic status of all convicted individuals prior to the next hearing. This information is expected to play a role in the determination of an appropriate sentence. The legal team for Hussain aims to utilise the additional time to prepare their submissions thoroughly.
