He emphasises that inheritance thus tends to minimise upfront costs and has the added benefit of tax exemptions, as estate duty is no longer levied in India.

Aman Gupta, a director at RPS Group, corroborates this perspective, highlighting that legal heirs are exempt from both income tax and stamp duty upon receiving an inherited property, making this route more appealing from a cash flow standpoint. The financial implications reveal that the stages at which costs arise play a pivotal role in guiding families toward their decision.

The Cost of Gifting Property

While gifting property can be a straightforward process, it often involves overlooked costs that may weigh heavily on families. One significant factor is the stamp duty, which applies to property gifts and varies widely across different states in India. While inheritance does not attract this charge, gifting properties incurs immediate financial responsibilities that can fluctuate based on locality.

Pharande illustrates the point, stating that the variation in state rates can greatly affect the overall expenses. For example, Delhi imposes a stamp duty of around 2% for gifts between close relatives, while states like Maharashtra impose minimal rates for certain family transfers. However, many states can charge as much as 7% of the property’s value for gifts, making gifting a financially burdensome option.

Most families are primarily concerned about income tax; however, the true financial impact often stems from stamp duty. Proper documentation during property transfer is crucial in mitigating potential disputes and ensuring future capital gains calculations are based on accurate valuation records.

Implications of Selling Inherited Property

One common misconception revolves around the taxation of inherited properties upon their eventual sale. It is frequently believed that selling inherited assets incurs different tax implications than selling gifted ones. However, both inherited and gifted properties adhere to similar tax regulations under the Income Tax Act.

Gupta clarifies that both categories of property maintain their original owner’s acquisition cost and holding period, meaning capital gains taxes are computed based on these parameters. Thus, there exists no substantial difference in capital gains treatment simply because property was inherited instead of gifted.
