Ajay Devgn Challenges FDA Notice in Bombay High Court Over Pan Masala-Linked Advertisement

The CSR Journal Magazine

Ajay Devgn has approached the Bombay High Court to contest a notice issued by the Maharashtra Food and Drug Administration (FDA) regarding his alleged promotion of a brand associated with pan masala through an advertisement. The FDA’s notice also targets fellow actors Shah Rukh Khan and Tiger Shroff, who are similarly linked to the advertisement for a chewing elaichi (cardamom) brand. The regulatory body claims that the advertisement may serve as an indirect promotion of a product tied to pan masala.

Details of the FDA’s Notice

The FDA issued the notices on August 14, requesting explanations from the actors concerning their involvement in the advertisement and their connection to the brand. Notices were dispatched to Devgn at his residence in Juhu, to Shah Rukh Khan at his residence Mannat in Bandra, and to Tiger Shroff through his production house, Tiger Shroff Productions. The FDA contends that the advertisement potentially violates the provisions of the Food Safety and Standards Act and its amended rules.

According to the FDA, the advertisement creates an association with a brand primarily linked to pan masala, which is a concern given the state government’s order prohibiting the manufacture, storage, transportation, distribution, and sale of such products for one year. This action against the actors is part of a broader enforcement initiative by the Maharashtra FDA aimed at tackling gutka and pan masala products that contain tobacco or nicotine.

Despite Devgn’s legal challenge, there is currently no stay on the FDA’s adjudication proceedings. Consequently, the regulatory process initiated against the actors will continue, even as the matter is taken up by the High Court. Devgn’s plea is slated for hearing on November 4.

Previous Legal Developments

This recent legal action follows a dismissal by the Delhi High Court of a plea filed by the three actors, which sought to challenge the FDA notices. The court noted that the jurisdiction to hear such matters lies with the courts in Maharashtra. The FDA’s scrutiny of the advertisement has garnered attention, particularly in light of ongoing efforts to regulate food safety and combat the promotion of harmful products.

The Maharashtra FDA has been actively conducting inspections and seizures related to various food safety violations. These include issues surrounding adulterated milk, food served in restaurants, and the sale of junk food near schools. The enforcement drive is part of a larger initiative to ensure compliance with food safety regulations and to curb the distribution of banned gutka and tobacco-containing pan masala.

The controversy surrounding the chewing elaichi brand is not unprecedented. In 2022, actor Akshay Kumar faced considerable backlash for endorsing the same brand alongside Shah Rukh Khan and Ajay Devgn. Following public criticism, Kumar publicly apologised and announced his decision to withdraw from the endorsement, stating that he would donate the entire endorsement fee to a charitable cause.

Implications for the Actors Involved

The ongoing situation poses significant implications for the actors involved, particularly as they navigate the legal landscape surrounding food safety regulations. The FDA’s actions highlight the increasing scrutiny of celebrity endorsements in relation to products that may have health implications. As the hearing date approaches, the actors will need to prepare their responses to the allegations made against them.

Furthermore, the case underscores the broader challenges faced by the entertainment industry in balancing promotional activities with regulatory compliance. The outcome of this legal battle may set a precedent for future endorsements and the responsibilities of celebrities in promoting products that could be deemed harmful.

As the situation develops, it remains to be seen how the Bombay High Court will rule on Devgn’s plea and the potential ramifications for the FDA’s ongoing enforcement efforts against products associated with pan masala and gutka.
