“You’re Imposing Hindu Succession Act on Muslims”: Owaisi Criticises Centre Over UCC Bill in Gujarat

Asaduddin Owaisi, the President of the All India Majlis-e-Ittehadul Muslimeen (AIMIM), has strongly condemned the central government regarding the Uniform Civil Code (UCC) Bill that was recently passed by the Gujarat State Assembly. He labelled the legislation an infringement on Muslim personal laws and a violation of constitutional rights. The AIMIM leader expressed his concerns during a press conference in Ahmedabad, asserting that these legal changes undermine the religious freedoms guaranteed by the Constitution.

Owaisi stated that the government is, in effect, forcing Muslim citizens to conform to the provisions of the Hindu Succession Act. He raised objections regarding the implications of the UCC, claiming it enforces a religious framework that does not align with Islamic principles. The politician emphasized that elements such as the requirement of proof of adultery for divorce are traditionally associated with Hindu customs, questioning why they should be imposed on Muslims.

He remarked that such measures constitute a breach of Article 21 of the Indian Constitution, which safeguards the right to life and personal liberty. Owaisi’s assertions reflect heightened concerns among Muslim communities regarding perceived encroachments on their legal and cultural practices.

Contentions Around Family Law Adjustments

Owaisi further elaborated on the implications of aligning Muslim laws with Hindu practices, particularly with respect to family law, maintenance, and inheritance issues. According to him, the proposed changes to these areas represent an undue influence from Hindu cultural tenets, which could lead to the erosion of Islamic family structures. He argued that the existing frameworks for maintenance, alimony, and succession, which are purportedly now being harmonised with Hindu laws, undermine the autonomy of Muslim personal law.

Criticising the government’s stance, Owaisi noted that the UCC fails to respect and incorporate the distinctive values of different religious communities. By aiming to standardise laws across all sects, the UCC may inadvertently strip away the unique legal identities that various groups have historically maintained.

Owaisi highlighted the inconsistencies in the government’s approach, particularly regarding modern social arrangements such as live-in relationships. He questioned the moral grounds cited by the ruling Bharatiya Janata Party (BJP) when proposing such legislation, arguing that it contradicts Islamic traditions and the sanctity of marriage. This aspect of the Bill was described as contradictory to the foundational beliefs of the Muslim community.

According to Patel, the establishment of equal laws is pivotal for fostering national unity and contributing to the broader agenda of societal development.

The emphasis on women’s rights and protections in the Bill is noteworthy, yet the controversies surrounding its implications for minority communities particularly highlight the ongoing tensions in balancing legal reforms with respect for religious diversity. The divergence in perspectives among various stakeholders indicates that the debate over the UCC will likely continue to unfold in the coming months.
