Supreme Court Orders Rs 6 Lakh Compensation for Man Wrongfully Detained for Six Years by Uttar Pradesh Police

The CSR Journal Magazine

The Supreme Court has ordered the Uttar Pradesh government to pay Rs 6 lakh as compensation to a man who spent six years in custody as an undertrial. This decision was made following the court’s criticism of the Uttar Pradesh Police for what it termed a “slipshod investigation” in a murder case. The court described the individual as a “victim of the system,” highlighting the severe impact of the wrongful detention on his life.

During the proceedings, the bench, comprising Justices J B Pardiwala and K Vinod Chandran, stated that the six years spent in custody were a result of a “concocted story” based on mere assumptions. The court emphasised that the state has a fundamental duty to protect its citizens and that a person accused in a criminal case is presumed innocent until proven guilty.

The justices remarked that the role of investigating and prosecuting agencies should not solely focus on securing convictions. Instead, these entities must see themselves as integral participants in the justice delivery system, responsible for ensuring justice for both victims and the accused.

Details of the Case and Acquittal

The Supreme Court’s ruling followed a petition filed by the accused, who challenged a January order from the Allahabad High Court that denied him bail in a case registered in Agra in 2019. The court noted that it had previously directed the trial court to conclude the trial within three months, which ultimately led to the petitioner’s acquittal.

The bench expressed concern over the manner in which the investigation was conducted, labelling it a classic example of how not to proceed with an investigation. The justices pointed out that the petitioner had been incarcerated since November 14, 2019, despite the lack of evidence against him. They described the prosecution as haphazard, which fortunately resulted in the man’s acquittal.

The court further noted that the trial court had found the prosecution unable to substantiate any of the four key circumstances it relied upon, including electronic evidence. The justices stressed the need for the state police to enhance the training of their officers in investigative procedures.

Compensation and Future Implications

The Supreme Court concluded its ruling by directing that a copy of the verdict be forwarded to the Uttar Pradesh Director General of Police and the Home Secretary. It ordered the state to pay the compensation of Rs 6 lakh to the petitioner within one month, acknowledging that while this amount is minimal in comparison to the years spent in custody, it serves as a necessary reparation.

This ruling not only resolves the petitioner’s case but also serves as a cautionary note to the state regarding the conduct of investigations and prosecutions. The court’s decision highlights the importance of ensuring that justice is delivered fairly and efficiently, safeguarding the rights of all individuals within the legal system.

The Supreme Court’s stance reiterates the necessity for accountability within law enforcement and judicial processes, aiming to prevent similar injustices in the future. The case underscores the critical need for thorough and diligent investigations to uphold the integrity of the justice system.
