Supreme Court Halts Coercive Action Against Punjab CM’s Aide

The CSR Journal Magazine

The Supreme Court has granted interim relief to Rajbir Singh Ghuman, the Officer on Special Duty (OSD) to Punjab Chief Minister Bhagwant Mann. This ruling prohibits the Central Bureau of Investigation (CBI) from taking any coercive measures against him while the ongoing investigations into allegations of corruption continue. The order was issued by a bench of the Supreme Court on Monday, allowing for the investigation to progress but ensuring Ghuman’s protection from immediate coercive actions.

Upon examining a petition from the Punjab government, the Supreme Court issued a notice that effectively challenges the directives given by the Punjab and Haryana High Court. These earlier directions had ordered the registration of a First Information Report (FIR) and instigated a CBI probe into the alleged corruption. Although the court did not choose to quash or suspend the FIR at this stage, it maintained that no coercive action would be taken against individuals linked to the ongoing inquiry.

The Supreme Court’s directive also highlighted the necessity for the Punjab government and related state authorities to fully cooperate with the investigative process. This ruling grants Ghuman temporary protection, although it does not stop the CBI’s ongoing investigation into the allegations surrounding him and others associated with the Chief Minister’s Office.

Details of the Allegations Against Ghuman

The corruption allegations against Rajbir Singh Ghuman originate from communications initiated by the Enforcement Directorate (ED). These communications were directed towards the Punjab Director General of Police and raised concerns regarding corrupt practices involving government transfers, postings, policy decisions, tender processes, and land-related transactions. The ED has reportedly named several individuals in these allegations, Ghuman included, accusing them of allowing private entities to exert influence over government decisions in exchange for financial or other benefits.

These claims surfaced during an ED investigation into a money laundering case that involved a housing society and marked irregularities in the acquisition of Change of Land Use (CLU) permissions. The ED raised issues regarding the potential utilization of forged consent letters and suggested that individuals affiliated with the Chief Minister’s Office were implicated in these matters.

After the Punjab Police did not act upon the ED’s communications by filing an FIR, advocate Nikhil Saraf sought intervention from the Punjab and Haryana High Court, urging for an independent investigation into the allegations. On October 5, the High Court instructed the CBI to initiate a criminal case and investigate the claims, while also requiring the Punjab government and Police to provide necessary documentation and assistance to the agency.

Punjab Government’s Legal Challenge

In response to the High Court’s order for a CBI investigation, the Punjab government has appealed to the Supreme Court. The state has questioned the legal grounds of the High Court’s directives, specifically challenging the necessity of obtaining prior approval before any investigation concerning decisions made by public servants in their official capacities.

The Punjab government’s petition contends that the High Court’s order mandatorily calling for an FIR related to transfers, tenders, and policy decisions failed to acknowledge the legal protections applicable to public servants. While the Supreme Court has acknowledged the Punjab government’s plea through a notice, it has opted not to suspend the FIR or cease the investigation. The interim relief against coercive action serves as a temporary measure while the legal contestation persists.

The investigation into the allegations against Ghuman and others remains ongoing, and the claims have yet to be established through judicial proceedings in court. The Supreme Court’s latest decision adds a layer of complexity to the situation, leaving the legal process to unfold in due course.
