Supreme Court Vows “No Genuine Voter Will Be Left Out” Amid Displeasure Over SIR in West Bengal

In a significant intervention regarding the Special Interim Revision (SIR) of electoral rolls in West Bengal, the Supreme Court of India has assured citizens that every eligible voter will be protected. Chief Justice Suryakant, presiding over a bench on Tuesday, expressed sharp dissatisfaction with the State Government’s latest legal challenge, labeling it “premature” and potentially damaging to public trust in the judicial system.

Judicial Officers to Lead Voter Verification

The Court emphasized that judicial officers are currently painstakingly reviewing the lists of unresolved voter applications. To ensure this process remains unhindered, the bench issued a series of mandates to the Election Commission of India (ECI) and state authorities:

Unrestricted Access: The ECI must immediately provide judicial officers with necessary login credentials and technical IDs to access voter databases.

Total Cooperation: Both the State and the Commission are legally bound to assist these judicial officers in their verification duties.

Supplementary Lists: Addressing concerns raised by the ruling Trinamool Congress regarding delays, the Court ordered the swift publication of supplementary voter lists.

“Don’t Question the System”: CJI Warns State Counsel

During the hearing, the Chief Justice addressed Senior Advocate Menaka Guruswamy, representing the State. The Court took umbrage at the State’s move to file a fresh petition alleging that valid records were being ignored and names were being excluded.

“By filing such premature petitions, you are sending a message that you lack faith in the established system,” Chief Justice Suryakant remarked, suggesting that the counsel withdraw the application.

The Chief Justice further noted that the High Court Chief Justice has already confirmed that over one million cases have been processed. “Do not cast aspersions on the work of judicial officers. I am speaking sternly—those who are genuine voters will be included,” he added.

New Oversight Tribunal Proposed

To maintain absolute transparency as the state heads toward elections, the Supreme Court outlined a new framework for dispute resolution:
1. Special Tribunal: A dedicated tribunal, headed by a former Chief Justice and comprising several judges, will be established to oversee electoral roll grievances.

2. Consultative Process: The ECI has been directed to work in close consultation with the Chief Justice of the High Court to manage the tribunal’s operations.

3. Contempt Warning: The bench cautioned that it would not hesitate to issue contempt notices if any party attempts to obstruct the court-ordered verification process.

The Court concluded by reiterating its commitment to a “clean” voter list, ensuring the process is completed well before the commencement of polling.
