Noida Implements Section 163 Restrictions Until October 20 Amid Protests

The Gautam Buddh Nagar Police have announced restrictions across the district under Section 163 of the Bharatiya Nagarik Suraksha Sanhita. These measures, aimed at curbing gatherings, will take effect from Saturday morning and remain in place until October 20. The restrictions are particularly relevant given the coinciding festivities and ongoing protests in the region.

These prohibitory measures follow a significant announcement by the Cockroach Janata Party, which is organising a major protest in neighbouring Delhi. The protest aims to demand the resignation of Chief Election Commissioner Gyanesh Kumar amid allegations of electoral irregularities put forward by opposition parties and various organisations.

Farming groups and youth organisations are reportedly mobilising participants from around the country, including Uttar Pradesh, to join the demonstrations. In anticipation of these activities, security checks have intensified, with additional police and security personnel, including forces from the Border Security Force, deployed at Noida’s borders with Delhi.

Details of the Prohibitory Measures

The order, issued by Additional Deputy Commissioner of Police (Law and Order) Archana Singh, aims to cover significant upcoming events, including the Navratri festival starting on October 11 and the celebrations of Dussehra and Mahanavami on October 19 and 20. It also addresses various ongoing demonstrations from different groups over a range of demands.

The directive states that the potential for anti-social elements to disturb public order cannot be discounted. Consequently, the order was issued without prior hearings, citing the urgent need for such measures in light of the current situation.

No person is permitted to organise or participate in any procession on public thoroughfares or at toll plazas, or to gather in groups of five or more in public spaces without obtaining prior consent from the relevant police authorities. Notably, while some exemptions may be granted for authorised government programmes, other specific prohibitions cover a range of activities, including provocative speeches and the unauthorised use of drones.

Prohibitions and Penalties for Violations

The order further enforces restrictions against the use of loudspeakers from 10 pm to 6 am and prohibits religious gatherings on public roads without permission. Additionally, it disallows unauthorised worship at contentious sites, carrying or displaying weapons, celebratory firings, public consumption of alcohol, and the distribution of misleading information.

Moreover, businesses must adhere to these regulations, as forced closures or disruptions to essential supplies, along with the sale or use of “Chinese” manjha, are forbidden. Similarly, within a 200-metre radius of examination centres, large gatherings, unauthorised loudspeakers, and photocopying will be restricted, while electronic devices are also banned without prior permission.

Enforcement of these prohibitions will be active until October 20, unless further modifications are made through new directives from the Uttar Pradesh government. Violators may face penalties under Section 223 of the Bharatiya Nyaya Sanhita, 2023. This comprehensive order aims to establish significant restrictions across Gautam Buddh Nagar, thus addressing both the festival season and heightened protest activities effectively.
