The Gujarat High Court has turned down the interim bail application of Asaram Bapu, a self-proclaimed spiritual leader and convicted rapist. This request was made for a temporary release of 20 days on humanitarian grounds, specifically to allow him to visit his wife, who is currently hospitalised at the age of 83. The court has instead granted him permission to communicate with her via video call.

Details of the Bail Application Reviewed

A division bench comprising Justices Geeta Gopi and LS Peerzada evaluated the bail plea after examining a police report regarding the health of Asaram’s wife. The court had previously instructed the police to verify her condition and submit relevant findings, which included statements from doctors attending to her. During the hearing, Asaram’s legal representatives emphasised his age of 86 and expressed their concerns about his wife’s health.

In response to the plea, the government lawyer provided insights from the medical reports presented to the court. It was noted that Asaram’s wife has been responding well to her treatment, and her health status was assessed as stable. Furthermore, the medical professionals indicated that she was expected to be discharged from the hospital in two to three days, which diminished the necessity for Asaram’s immediate physical presence.

The opposition counsel argued against the bail, asserting that Asaram’s wife was receiving care at a multi-specialty hospital and was accompanied by both relatives and her personal physician. This information played a significant role in the court’s decision to deny the request for bail.

Video Conferencing Permission Granted

Despite rejecting the bail application, the Gujarat High Court has allowed Asaram to request the jail superintendent’s approval for a video call with his wife. This alternative means of communication offers a temporary solution, ensuring that Asaram can still connect with his wife during her hospitalisation.

Asaram is currently serving a life sentence following his conviction in a 2013 rape case. Earlier this month, he had also faced the rejection of another interim bail plea, indicating the judiciary’s consistent stance on his requests for temporary release.
