Bombay High Court Criticises Imran Khan Over Leave-India Notice

The CSR Journal Magazine

he Bombay High Court has expressed strong disapproval of actor Imran Khan’s involvement in a protest against the Election Commission. The court reminded Khan of his status as an American citizen who holds an Overseas Citizen of India (OCI) card, emphasising that he cannot act as if he is an Indian citizen. During the proceedings, the bench highlighted the implications of his actions, questioning his entitlement to engage in such demonstrations.

The court’s remarks included a hypothetical scenario regarding how the United States would respond if an Indian national participated in similar protests on American soil. The judges conveyed their concerns about Khan’s right to voice opinions on Indian matters, stating, “You are an OCI card holder. You can’t behave like an Indian citizen. You have nothing to say about SIR, you had no right to participate.” This statement was directed at Khan’s legal representative, senior advocate Venkatesh Dhond.

Concerns Over Citizenship Status

During the hearing, the court further probed why Khan, who has spent the majority of his life in India and has established a successful career in Bollywood, had not chosen to acquire Indian citizenship. The judges questioned, “Since your childhood you have been here. Why don’t you accept Indian citizenship? You have become a Bollywood star here.” This line of questioning suggested that the court viewed Khan’s long-term residence in India as a significant factor in determining his citizenship options.

The judges also remarked on the duration of Khan’s stay in India, suggesting that he had become so accustomed to life in the country that he might have lost sight of his OCI status. “You probably lived too long here… over 40 years to remember that you are an OCI card holder,” the court observed. This comment underscored the court’s perception of Khan’s integration into Indian society and the expectations that come with such a status.

The comments and inquiries from the bench occurred during the hearing of Khan’s petition, which challenges a Leave India Notice (LIN) issued by the Foreigners Regional Registration Office (FRRO). This notice, which mandates Khan to leave India, had been temporarily suspended by a bench comprising Chief Justice MC Tripathi and Justice Advait Sethna in the previous week.

Legal Implications of the Leave India Notice

The Leave India Notice issued against Khan has raised significant legal questions regarding the rights of OCI cardholders in India. The court’s scrutiny of Khan’s actions and citizenship status has implications not only for him but also for other individuals in similar situations. The ongoing proceedings highlight the complexities surrounding the rights and responsibilities of OCI cardholders, particularly in relation to their participation in political and social activities within India.

As the case continues to unfold, it remains to be seen how the court will ultimately rule on Khan’s petition and the broader implications for OCI cardholders. The legal discourse surrounding this matter could set important precedents regarding the intersection of citizenship, residency, and political engagement in India.

The Bombay High Court’s critical stance towards Khan serves as a reminder of the legal frameworks governing foreign nationals in India and the expectations that accompany their residency status. The outcome of this case may have lasting effects on how OCI cardholders navigate their rights and responsibilities in the country.
