Supreme Court Issues Notice on Plea Seeking CBI Probe Into Medical Data Leak

The CSR Journal Magazine

The Supreme Court of India has issued a notice to the Centre and relevant State authorities concerning a petition that demands a Central Bureau of Investigation (CBI) inquiry into an alleged large-scale breach of medical data. This incident reportedly involves the personal and medical information of over 1.5 lakh Indian citizens being transferred to a server located in Singapore. The notice was announced during a session on August 6, 2026.

The Bench hearing the petition comprises Chief Justice of India (CJI) Surya Kant along with Justices V. Mohan and Joymalya Bagchi. These judges instructed the respondents to provide their inputs after hearing from Senior Advocate K. Parameshwar, who represents the petitioner in this case.

Allegations and Concerns Raised

During the proceedings, the Bench identified that the offences associated with this case under the Information Technology Act could require a reassessment of legal frameworks. Justice Joymalya Bagchi specifically pointed out that the Court had previously requested the Solicitor General of India to look into the necessity for amendments to this act. This raises questions about existing protections for personal data in the digital era.

The counsel representing the petitioner stated that complaints regarding this alleged data breach were originally filed as early as March 2025. However, it was not until August 2025 that a First Information Report (FIR) was officially registered by local police. The FIR is reportedly still active against unidentified individuals, despite the petitioner claiming to have provided specific details regarding the source of the breach and the overseas server involved in the incident.

The petition outlines that companies associated with Bessemer Venture Partners—namely Remedinet Technologies, IHX, Medi Assist, and Perfios—are allegedly connected to this cyber incident. The sensitive personal data purportedly compromised includes crucial information such as Aadhaar numbers, Permanent Account Numbers (PAN), alongside various medical records.

Next Steps and Court Proceedings

The ongoing case is now awaiting further hearings in the Supreme Court. Legal experts anticipate that the outcome could have significant implications for data privacy regulations in India, especially in how breaches of this nature are addressed and investigated.

The public and various stakeholders are closely watching the case, as the judicial ruling may very well influence future protocols for handling personal data within the country. The Supreme Court’s focus on the necessity of legislative review underscores the urgency with which digital data security needs to be approached in an increasingly connected world.

As the situation unfolds, it highlights the critical importance of safeguarding personal information against potential cyber threats. The outcome of this case could set a precedent for how similar cases are treated in the future, thereby shaping the landscape of data privacy laws in India.
