Background of the Case

The Supreme Court has deferred the hearing of a plea by Jagtar Singh Hawara, who is serving a life sentence for the assassination of former Punjab Chief Minister Beant Singh in 1995. Hawara’s request to be transferred from Tihar Jail in Delhi to a prison in Punjab was postponed following inputs from the Intelligence Bureau (IB) that suggested such a move could significantly influence the upcoming assembly elections in the state, scheduled for next year. The court has decided to revisit the matter after February 2027.

Details of the Plea and Court Proceedings

Hawara, who has expressed a desire to relocate to Punjab where his elderly mother and family reside, filed his petition with the Supreme Court. Last month, the court sought the opinion of the IB after both the Delhi and Punjab governments, along with the Chandigarh administration, raised concerns regarding the request. The bench, comprising Justices MM Sundresh and PB Varale, acknowledged that they would typically be amenable to such requests; however, they noted that the information provided by the IB was particularly alarming.

According to the IB note, the transfer could have a profound impact on the electoral landscape, especially given the current political climate, both domestically and internationally. Senior advocate S. Muralidhar, representing Hawara, argued that if the upcoming elections were the primary concern, the court might consider postponing the hearing. He indicated that he had not seen the IB report but believed that the security conditions in Punjab’s jails were comparable to those in Tihar, which should not raise objections from the Union government.

The court has scheduled the next hearing for after February, when the elections are anticipated to conclude. Hawara’s petition highlights the advanced age of his mother and requests parole to visit his family. The court previously noted the apprehensions expressed by the Punjab and Chandigarh administrations and emphasised that its order should not lead to further complications.

Legal and Historical Context

Hawara’s legal team has previously argued that he was only 21 years old at the time of Beant Singh’s assassination and has since come to terms with the consequences of his actions. The Union government, however, contended that Hawara has been convicted in six separate cases and was involved in a notable jailbreak in January 2004, during which he escaped from Burail Jail in Chandigarh by digging a tunnel. He was later recaptured.

Punjab Chief Minister Bhagwant Mann has also reached out to the governor, requesting a 10-day parole for Hawara on humanitarian grounds. Hawara was convicted for a bomb blast outside the Civil Secretariat in Chandigarh on August 31, 1995, which resulted in the deaths of Beant Singh and 16 others. In 2010, the Punjab and Haryana High Court commuted his death sentence to life imprisonment, stipulating that he must remain incarcerated for the rest of his life. An appeal against this ruling is currently pending before the Supreme Court.

Previously, the Delhi High Court had dismissed Hawara’s request to be transferred to a prison in Punjab, which adds another layer of complexity to his ongoing legal battles. The Supreme Court’s decision to defer the hearing reflects the sensitive nature of the case, particularly given the implications it may have for the political environment in Punjab.
