Sunjay Kapur’s Will has been in discussion for a while after his death, in a major turn of events, now mother of Sunjay Kapur, Rani Kapur has approached Delhi High Court accusing daughter-in-law, Priya Kapur of “fraudulent” trust and unlawfully diversion of family estate. In the civil suit, Rani Kapur has sought a declaration that the trust name ‘RK Family Trust’ or the ‘Rani Kapur Family Trust’ formed in October 26, 2017, is “illegal, void, and the result of fraud, forgery, and undue influence”.
Rani has even asked for the dissolution of the trust, restitution of assets, rendition of accounts, and permanent injunctions restraining Priya (defendant) from being benefited from the trust. The suit reads, “It is submitted that by means of a complex web of illegal transactions undertaken in an unfortunate collusion with the plaintiff’s (Rani Kapur) son Sunjay Kapur, all the plaintiff’s assets vest in one fraudulent Trust titled – RK Family Trust, without her knowledge. The entire fraud perpetrated upon the plaintiff has only now been discovered post the death of her son, who also passed away under mysterious circumstances,”.
Rani also hints on the murder conspiracy of his son Sunjay Kapur, 53, who died while playing polo in London on June 12 last year. While the reason for the death is stated as cardiac arrest, the report states that he got an anaphylactic shock post a bee entered his mouth.
What does Rani Kapur’s suit state?
As per the suit, Rani Kapur is legatee and sole beneficiary of the estate that her husband, Surinder Kapur founded, the Sona Group. On February 6, 2013, Sunjay’s father had bequeathed all his movable and immovable assets, including his shareholding in Sona Group companies to his wife. Even in 2016, this will was probated by her three children, that includes Sunjay Kapur.
In the suit, Rani Kapur alleges that after she suffered stroke in September 2017, and she was dependent on her son Sunjay Kapur and his wife, Priya Kapur, Priya took advantage of her situation and diverted all assets into the RK Family Trust, and she wasn’t consulted nor taken consent from. The suit further states that she never created such a trust, rather in 2016, two trusts were created named Dr SK Family Trust and the MK Family Trust, and no such trust as RK Family Trust existed.
Meanwhile, in a criminal defamation case against Sunjay’s sister Mandira, Priya has recorded a statement in Patiala High Court, Priya said that the podcasts, interviews and content on social media has been posted as a campaign to tarnish her reputation. She even noted that the statements made in the media were false and personal attacks.
