Himachal Pradesh Assembly Approves Bill to Deny Pension to Disqualified MLAs

The Himachal Pradesh Assembly has passed the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Amendment Bill, 2026, on the final day of its Budget Session. This newly approved Bill introduces a provision that disallows pension benefits for legislators disqualified under the anti-defection law. Chief Minister Sukhvinder Singh Sukhu moved this Bill, which amends the original 1971 Act that governs the salaries, allowances, and pensions of Members of the Legislative Assembly (MLAs).

According to the new provision, any MLA disqualified under the Tenth Schedule of the Indian Constitution for defecting will no longer be entitled to receive pension benefits. This marks a significant alteration in how the state legislature manages pensions for its members, especially those who change party allegiance.

Objectives of the Bill

In presenting the Bill, Chief Minister Sukhu articulated that the current legal framework lacked adequate measures to deter defections. He asserted that this amendment seeks to preserve the public mandate and reinforce democratic values within the political system. Sukhu also expressed concerns regarding opposition from the Bharatiya Janata Party (BJP), suggesting that such resistance to the amendment promotes what he called “Operation Lotus,” a term often used to describe political manoeuvring to induce defections.

The Chief Minister emphasised that the amendment aims to prevent the commodification of democracy, aiming to assure citizens that elected representatives cannot easily abandon their responsibilities in exchange for personal gain. By articulating these objectives, the government hopes to cultivate a more stable political environment.

However, the implications of this Bill extend beyond its immediate objectives, as it will also serve to impose financial repercussions on those MLAs who fail to adhere to their party whips during crucial votes.

Opposition’s Response to the Legislation

The opposition party has openly criticised the Bill, labelling it as a politically driven initiative aimed at specific individuals rather than a broader regulatory measure. Leader of the Opposition Jai Ram Thakur raised concerns about the motives behind the introduction of this amendment, especially since a similar proposal had failed to garner support in the past. He questioned why the government had reintroduced it now, suggesting that the move appears targeted towards particular former legislators.

Thakur further noted that the previous attempt to revoke pensions for all MLAs was not approved, in contrast to the apparently selective approach taken with the current Bill. He warned that this legislation could face legal challenges if it is perceived as discriminatory.

As a result of the new Bill, pension benefits for former Congress MLAs Chaitanya Sharma and Devender Kumar Bhutto are set to be revoked. Both legislators had crossed party lines during the Rajya Sabha elections in February 2024, which constituted a violation of party protocol.

Support from Legislative Leadership

Assembly Speaker Kuldeep Singh Pathania has expressed support for the new legislation, arguing that it sets a precedent for other states. Pathania believes that discouraging defections will help strengthen the democratic framework in the state. He remarked that the move could serve as a model for legislative bodies seeking to enforce stricter adherence to party discipline among their members.

This legislative action follows from earlier efforts to establish similar parameters governing pensions, which had previously been unsuccessful due to lack of presidential assent. The passage of this amendment marks a new chapter in the bid to regulate the behaviour of MLAs in Himachal Pradesh while potentially influencing other state legislatures across India.
