Goa Court Grants Bail to Ajay Gupta Following Nightclub Fire Incident

The district court in Mapusa, North Goa, has granted bail to Ajay Gupta, co-owner of the ‘Birch by Romeo Lane’ nightclub. This decision came after he was arrested over three months ago in connection with a fire at the establishment that led to the loss of 25 lives in December. Gupta’s lawyer, Rohan Desai, confirmed the bail grant on Tuesday.

Details of the Tragic Incident

The devastating fire occurred on December 6 at the ‘Birch by Romeo Lane’ nightclub, resulting in numerous fatalities and injuries. Gupta, along with his fellow co-owners Gaurav and Saurabh Luthra, faces serious allegations of negligence and violations of safety regulations. The Goa police indicated that a firework event was conducted at the club without adequate fire safety measures in place, raising alarms about the establishment’s readiness to handle emergencies.

Negligence and Legal Ramifications

Authorities have highlighted that the Luthra brothers proceeded with the fire show despite being aware that the club lacked essential emergency exit facilities on its ground and deck levels. This oversight prompted the Goa Police to file a criminal case on December 7 at the Arpora Anjuna Police Station. The case has been registered under several sections of the Bhartiya Nyaya Sanhita 2023, focusing on negligence and endangerment.

Actions Taken by Goa Government

In response to the nightclub fire incident, the Goa government moved forward with disciplinary actions against local officials. The Sarpanch of Arpora Village, Roshan Redkar, and Panchayat Secretary Raghuvir Bagkar were dismissed from service in January due to what was described as “persistent negligence” in managing the safety protocols associated with the nightclub.

Official Findings on Club Operations

The Directorate of Panchayats, following a Magisterial Inquiry Committee’s report on the incident, pointed out significant irregularities in the operations of the nightclub. It was noted that the ‘Birch by Romeo Lane’ was originally managed within a temporary structure which had been transformed into a nightclub without the required conversion sanction or approved architectural plans. The report condemned the administrative neglect and emphasized the violation of public trust that transpired leading up to the fire incident.

Concerns Highlighted by Authorities

The Directorate’s order raised critical concerns regarding accountability among those in positions of authority. The phrase, “What will happen if the protectors themselves become poachers?” was used to question the responsibility of officials overseeing the safety norms of public establishments.
