Centre Contemplates Abolishing NOC Requirement for Inter-State Vehicle Transfers

The Indian government is evaluating a significant proposal aimed at easing the procedure for transferring vehicles between states. This initiative involves the potential removal of the No Objection Certificate (NOC) requirement from the Regional Transport Office (RTO) of the original state. The discussions are taking place in light of recommendations made by a high-level committee focused on non-financial regulatory reforms, which was constituted by NITI Aayog. Should this reform be implemented, vehicle transfers could be processed through an automated system that utilizes data from the national vehicle registry, facilitating digital verification that could replace the need for a physical NOC.

Current Requirements for Vehicle Transfer

Presently, vehicle owners intending to move their vehicles to a different state must first secure an NOC from the RTO in which the vehicle is registered. This certificate is essential as it certifies that there are no outstanding road taxes, fines, or other financial obligations connected to the vehicle, which must be resolved prior to re-registration in the new state. The transfer process necessitates the submission of several documents, including the vehicle’s registration certificate, fitness certificate, and proof of tax payment, alongside the NOC.

Digital Transition with VAHAN System

The reform committee has highlighted that a majority of vehicle records are already digitized within the national vehicle database under the VAHAN system. Given that transport authorities across India have access to this database, it is suggested that checks regarding ownership details, tax status, and any outstanding penalties could be conducted electronically. The envisioned system would allow for these verifications to be completed automatically, enabling transport departments in various states to authorize vehicle transfers without the necessity of a physical NOC.

Proposed Shift to Fitness-Based Regulations

In addition to streamlining the transfer process, the committee has proposed a reevaluation of existing regulations that impose age limits on vehicles. Currently, numerous transport regulations restrict the use of vehicles after they surpass a predetermined number of years since initial registration. The committee argues that such age restrictions may compel functioning vehicles off the road despite adhering to safety and emission standards. Instead, a fitness-based approach has been suggested, which emphasizes regular and rigorous fitness inspections to ascertain a vehicle’s operational status.

Comparison with International Standards

This fitness-based method is akin to practices observed in several international markets, where vehicles are permitted to remain in service as long as they comply with specified safety and fitness criteria, irrespective of their age. If these proposed reforms are enacted, they could considerably simplify the process for inter-state vehicle transfers, while also reducing bureaucratic challenges faced by vehicle owners moving across state lines.
