Supreme Court Dismisses Petition Seeking to Stop Babri Masjid Replica Construction in West Bengal’s Murshidabad

The Supreme Court of India has rejected a petition aimed at halting the construction of a mosque named after Babri Masjid in Murshidabad. The plea argued that Mughal emperor Babar was an “anti-Hindu invader” responsible for atrocities against Hindus. Justices Vikram Nath and Sandeep Mehta presided over the case and dismissed the request after hearing brief arguments from the petitioner.

Details of the Petition

During the proceedings, the petitioner’s lawyer brought forth claims regarding the mosque’s construction in Murshidabad, associating it with Babar’s historical actions. The petitioner contended that the building of the mosque undermines the sentiments of the Hindu community. This legal effort coincided with a significant event on December 6, 2025, when Humayun Kabir, the chief of the Jan Unnayan Party and former MLA from the Trinamool Congress, laid the foundation stone for the mosque.

Humayun Kabir emphasized the rights of the 37 percent Muslim population in West Bengal to construct the mosque, asserting that no legal barrier would prevent its establishment. He remarked, “No one can move a single brick, as the Muslim community will build it at any cost.” Kabir stated that he is exercising a constitutional right to construct places of worship, drawing comparisons with temples and churches that can also be built by others.

Future Plans

In addition to the mosque, Kabir outlined plans for the construction of a hospital and a university in the area. He reiterated his commitment to developing the facilities intended to benefit the community, stating, “A Babri Masjid will be built here, along with a hospital and university.” Kabir has also indicated that he is prepared to face legal challenges, claiming that such efforts will not deter the construction process.
