Plea Seeks Contempt Action Over Delhi Metro Shutdown Despite Supreme Court Order

A petition was submitted to the Supreme Court on Saturday, urging the initiation of contempt proceedings against several authorities. This follows claims of non-compliance with a court order stating that there must not be a complete prohibition on the operation of Delhi Metro services and Indian Railways trains destined for Delhi on October 10 due to a protest organised by the Cockroach Janta Party (CJP).

The petition, filed by Shailendra Mani Tripathi, involves Union Home Secretary Govind Mohan and other officials as respondents. It alleges that, in defiance of the Supreme Court’s directive issued on October 9, numerous metro stations in the capital remained closed, significantly impacting public life and inflicting hardship on citizens.

Details of the Supreme Court Order

The Supreme Court’s October 9 ruling was delivered during a hearing related to a separate case concerning the shutdown of 57 metro stations and the cancellation of trains to Delhi due to the planned protest. The court highlighted the necessity for public transport services to continue functioning amidst such events. During the hearing on Friday, Chief Justice Surya Kant, along with Justices Joymalya Bagchi and V Mohana, directed the authorities to avoid any complete halt to metro services and train operations leading into the city.

The court emphasised the need for balance, stating that law enforcement agencies have the authority to implement restrictions where necessary, though citizens must not face undue challenges. The judges noted that the ongoing notifications appeared to overreach by imposing an outright ban on crucial public transportation.

The Solicitor General of India acknowledged this perspective, agreeing to encourage the authorities to reconsider the extensive prohibitions. The court further clarified that, while an outright ban should not exist, a prudent approach could allow regulated operation of metro and train services.

Public Transport and Advisory Measures

The judges specified that any decisions taken regarding the operation of metro trains and rail services should be communicated effectively to the public to prevent additional inconvenience. They stressed the importance of issuing a traffic advisory through various media, including newspapers and online platforms, to facilitate smoother traffic flow and mitigate public distress.

In response to the situation, Delhi Metro announced that 45 of its stations would be inaccessible from 9 pm on Friday until 6 pm on Saturday, citing security concerns linked to the protest. This latest plea aims to address the presumed failure to adhere to the Supreme Court’s direction, insisting that public transport systems should function within a regulated framework during such events.

This development underscores the necessity for clear communication and effective measures, particularly during significant public protests, ensuring that citizens have access to essential transport services while balancing security requirements. The court’s stance and the petition reflect an ongoing dialogue around the rights of citizens and governmental responsibilities during public demonstrations.
