The ongoing case involving allegations of religious sentiment violations and attempted forced conversion at a TCS facility in Nashik has recently escalated. Prosecutors informed a Nashik court on Monday that they have gathered supplementary evidence against the primary accused, Nida Khan. They disclosed that the investigation has broadened, extending beyond Nashik, with connections being made to Malegaon and Malaysia.

Special Public Prosecutor Ajay Mishra, addressing the court regarding Khan’s request for anticipatory bail, revealed that the Special Investigation Team (SIT) has uncovered indicators of Khan’s attempts to persuade one of the plaintiffs to embrace Islam. The details include allegations that Khan provided the complainant with a burqa and facilitated her immersion in religious practices.

According to the prosecution, it is claimed that Khan would invite the complainant to her residence to instruct her on prayer rituals and the proper wearing of a hijab and burqa. Reports also suggest plans to change the complainant’s name to ‘Hania.’ Investigators have found evidence, including Islamic-themed reels and social media links on the complainant’s mobile device.

Investigational Scope Expands

The prosecution has asserted that the case’s parameters have widened, with links to Malegaon and Malaysia now emerging. Allegations have also surfaced regarding co-accused Danish Sheikh, who allegedly took custody of the complainant’s educational and other essential documents, purportedly to hand over to a team in Malegaon for part of their alleged plan.

Furthermore, prosecutors claimed that the accused were preparing to facilitate the complainant’s relocation to Malaysia for employment via an individual named Imran. Ongoing investigations aim to ascertain the potential for any financial backing behind this alleged conspiracy, raising further questions about the nature of these activities.

During the hearing, Mishra informed the court that Nida Khan is currently evading authorities. He requested that her mobile phone be seized to determine if there were additional individuals involved in similar schemes. He argued for the denial of bail on the grounds that it could provide Khan with the opportunity to influence potential witnesses in the case.

Legal Arguments and Future Proceedings

Nida Khan’s attorney, Rahul Kasliwal, has refuted the allegations, emphasising that no laws exist in Maharashtra prohibiting religious conversion. Kasliwal contended that the charges cited under the Bharatiya Nyaya Sanhita pertain solely to the harming of religious sentiments and do not support claims of actual conversion taking place.

Additionally, the defence lawyer raised concerns regarding the filing of multiple FIRs associated with the case, arguing for the necessity of a single FIR instead of the current nine. The ongoing proceedings are set to be reviewed again on May 2, as the court considers the implications of the presented evidence and the arguments from both sides.

The court has yet to provide any protective measures for Khan, which leaves open the possibility of her arrest by police. As the investigation unfolds, the case continues to attract significant attention, both due to its implications for religious freedom and the legal processes involved.
