DMK president MK Stalin has approached the Madras High Court, contesting the victory of TVK candidate V S Babu in the Kolathur Assembly constituency election. In his petition, Stalin demands that Babu’s election be declared invalid while seeking recognition as the duly elected representative for the area.

Concerns Over EVM Verification Process

In his legal challenge, Stalin has specifically contested the District Election Officer’s assertion that the verification of the electronic voting machines (EVMs) used in Kolathur was successfully completed on August 5. He claims that significant irregularities surfaced during this verification, which were not adequately addressed by the election officials.

After the election results were announced, Stalin enlisted senior advocate N R Elango to act as his representative for checking the technology used in the voting process. This included examining the burnt memory or microcontroller components in the Control Unit, Ballot Unit, and VVPAT machines associated with fourteen selected EVM sets from the constituency.

Stalin reports that Elango identified what he termed as severe and concerning irregularities during the examination and promptly communicated these findings to the District Election Officer. Notwithstanding these claims, the officer still concluded that the verification had been executed successfully and adhered to established protocols.

Details of Allegations Presented to Officials

On August 6, a day after the verification was supposedly completed, Stalin submitted a formal letter to the District Election Officer outlining specific instances of failure that were observed during the verification process. He contended that the engineer’s certificates provided cannot be considered as sufficient technical or failure reports since they fail to explain the reasons behind the discrepancies noted.

Stalin rejected the district officer’s claims that the verification exercise was completed satisfactorily. He maintained that the impugned order was issued without proper consideration of the concerns raised by his authorised representative.

The petition also calls for a comprehensive re-evaluation of the results, including a directive for a complete counting of the VVPAT slips associated with the Kolathur constituency. Additionally, Stalin is urging the court to mandate the examination of all 286 voting machines that were deployed during the election.
