‘He’s Hale & Hearty’: Government Opposes Release of Sonam Wangchuk on Health Grounds

In the latest development regarding the detention of climate activist Sonam Wangchuk, the central government voiced its opposition to his release based on health concerns. The government asserted that Wangchuk is “hale and hearty,” indicating that his current health issues are minor.

Legal Proceedings

This statement was made during a session of the Supreme Court, in which Solicitor General Tushar Mehta addressed a bench of Justices Aravind Kumar and PB Varale. The court had previously queried the authorities about possibly reconsidering Wangchuk’s detention due to his health condition.

Wangchuk has been in custody under the National Security Act (NSA) for more than four months, following protests in Leh that resulted in fatalities and injuries.

Details of Wangchuk’s Health

Mehta emphasized that Wangchuk has undergone medical evaluations approximately 24 times, as mandated by jail protocols. He noted that Wangchuk was suffering from a digestive issue and a mild infection, which does not warrant his release.

He further argued that making exceptions for his release based on health could have negative repercussions and affect the integrity of the legal process regarding his detention.

Supreme Court’s Inquiry

The Supreme Court has previously highlighted concerns regarding Wangchuk’s medical condition and instructed the government to have his health assessed by a specialist. A medical report detailing Wangchuk’s health status was submitted to the court during the last hearing. His wife, Gitanjali Angmo, has filed a petition challenging his preventive detention.

Background of Detention

Wangchuk was detained on September 26 of the previous year amid a wave of protests aimed at securing statehood and Sixth Schedule status for Ladakh. The government has accused him of attempting to instigate political and social unrest in the region, drawing parallels to movements in Bangladesh, Sri Lanka, and Nepal.

As the legal proceedings continue, the Supreme Court seeks to balance the individual’s health concerns against the government’s rationale for Wangchuk’s continued detention.
