Gwalior Woman Throws 5-Year-Old Son From Terrace to Hide Extramarital Affair

The CSR Journal Magazine

In a chilling verdict, a Gwalior court has sentenced Jyoti Rathore to life imprisonment for murdering her five-year-old son, Jatin, by throwing him from a two-storey terrace.

The Additional Sessions Court ruled that the child was not a victim of an accident, but was deliberately killed to prevent him from revealing his mother’s extramarital relationship. The judgment was delivered on Saturday based on circumstantial evidence.

Incident Initially Reported as a Fall

The incident dates back to April 28, 2023, in the Thatipur police station area of Gwalior. Jatin suffered severe head injuries after falling from the terrace and was admitted to Jayarogya Hospital, where he died the next day. Initially, the family, including the child’s father, police constable Dhyan Singh, believed it to be an accidental fall.

Child Witnessed Mother With Lover

During investigation, police uncovered that Jyoti was on the terrace with her neighbour and alleged lover Uday Indaulia when Jatin reached there. According to prosecutors, the child saw his mother in an intimate moment with the man. Fearing exposure, Jyoti allegedly pushed her son off the terrace. Shockingly, she did not rush to help the injured child or visit him in hospital.

Confession Triggered by Guilt

About 15 days later, Jyoti reportedly broke down and hinted to her husband that she had committed a “grave mistake.” Sensing something amiss, Dhyan Singh secretly recorded multiple conversations and collected CCTV footage from their home. Confronted repeatedly, Jyoti eventually confessed to intentionally pushing her son.

The court relied on audio-video recordings, CCTV footage, and inconsistent statements made by the accused during crime scene recreation. Medical evidence confirmed that the injuries were consistent with a forceful fall. The prosecution argued the act was intentional, not impulsive.

Lover Acquitted for Lack of Proof

While Jyoti was convicted, her alleged lover Uday Indaulia was acquitted due to insufficient evidence linking him directly to the crime. The court emphasized that suspicion alone cannot replace proof.
