Gujarat Assembly Approves Uniform Civil Code Bill, Second State to Enact UCC After Uttarakhand

The Gujarat Assembly has successfully passed the Uniform Civil Code (UCC) Bill, marking a significant legislative development as the state becomes the second in India to implement such a code, following Uttarakhand. Chief Minister Bhupendra Patel articulated that this legislation is founded on the principles of equality and justice, applying uniformly across all communities, regardless of caste or religion.

Key Provisions of the UCC Bill

The UCC Bill seeks to establish mandatory regulations for various personal matters, including marriage registration, live-in relationships, divorce proceedings, and inheritance rights. A notable requirement mandates couples to register their marriages within 60 days, with non-compliance resulting in penalties of up to ₹10,000. Additionally, the Bill includes provisions to penalize forced or fraudulent marriages with imprisonment of up to seven years, reflecting a stringent stance on personal rights.

Divorce and Live-In Relationship Regulations

In the context of divorce, the legislation stipulates that any dissolution must be validated through court approval to be considered lawful. Failure to adhere to this requirement can lead to penalties of up to three years. Furthermore, the Bill empowers women to remarry without any preconditions following a divorce, promoting fair practices across different communities. The registration of live-in partnerships is also crucial, with penalties for non-compliance potentially including three months of imprisonment or fines up to ₹10,000. When individuals aged between 18 and 21 enter into such relationships, parental notification will be mandatory.

Chief Minister Patel underscored the Bill’s favorable implications for women and children, emphasizing that it ensures financial maintenance for women and secures legal recognition for children. “The registration process is designed to safeguard women from abandonment and enhance children’s rights regarding identity and inheritance,” he stated. The implementation of the UCC is seen as a proactive measure toward protecting vulnerable groups within society.

Following the successful passage of the Bill in the Assembly, Chief Minister Patel conveyed his congratulations through social media, characterizing the moment as historic for both Gujarat and India. A high-level committee, led by retired Supreme Court Justice Ranjana Prakash Desai, played a pivotal role in formulating the Bill’s provisions.
