Fresh FIR Filed Against Swatantra Bhardwaj Under POCSO Act Following Assault Allegations

A new First Information Report (FIR) has been registered against Swatantra Bhardwaj in relation to allegations involving a minor, as confirmed by the Delhi Police on September 5, 2026. The complaint pertains to incidents under the Protection of Children from Sexual Offences (POCSO) Act. Authorities have additionally incorporated provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act into the original FIR concerning the case.

As of the current date, the police have not apprehended Bhardwaj. This latest action follows the emergence of a viral video where Bhardwaj reportedly suggests that he evaded incarceration due to political connections after allegedly assaulting the father of activist Nishu Azad.

In responding to the public outcry, Bhardwaj stated that he falsely clarified the nature of the incident at Jantar Mantar, framing it as an act of “self-defence.” He contends that what has been portrayed as an attack was a necessary measure to safeguard himself.

Bhardwaj’s Claims of Self-Defence

During a recent interaction, Bhardwaj claimed that he was nearly attacked by a group of individuals during the protest. He asserted that his actions were solely for his protection, stating, “What people are calling an attack was an act of self-defence. If I had not acted in self-defence, I could have been lynched by the mob or killed.” He referenced a video as evidence of his account and mentioned the victim’s medical report indicated no serious injuries were sustained.

Furthermore, Bhardwaj dismissed the validity of the podcast clip circulating on social media, which has been attributed to certain public figures. He labelled it as a fabricated statement and sought to clarify that he does not possess undue influence, despite claims suggesting he is backed by political allies.

His remarks followed a growing narrative in the media and public discourse alleging negligence in legal proceedings. Bhardwaj asserted his commitment to cooperating with law enforcement throughout the investigation.

Political Reactions and Public Outcry

Congress Leader Rahul Gandhi has publicly supported activist Nishu Azad, criticising the government’s failure to act against alleged injustices faced by her family. In a post on X, Gandhi expressed solidarity with Azad, asserting that the Delhi Police has not undertaken sufficient action, despite the viral footage implicating Bhardwaj.

Gandhi’s comments highlighted a sentiment of frustration towards the apparent lack of accountability within the police force, specifically suggesting that individuals in power are shielding the accused. He remarked, “Amit Shah’s Delhi Police, on one hand, commits inhuman brutality against students. On the other hand, the criminal who smashed the head of a Dalit girl’s father is roaming freely in the open.”

In his post, Gandhi concluded with a call for justice, invoking phrases associated with social equity, “Jai Bhim. Jai Constitution.” His statements reflect a broader concern for social rights, which has resonated with various segments of the public and activists alike.

In parallel, the Cockroach Janata Party (CJP) organised protests in the nation’s capital, demanding appropriate legal actions against Bhardwaj. AAP chief Arvind Kejriwal has also invoked public discourse around the incident, questioning the perceived leniency towards Bhardwaj and invoking historical references to freedom fighters.
