Delhi High Court Issues Notice on Seema Rani Khakha Bail Plea in POCSO Case

The CSR Journal Magazine

The Delhi High Court has issued a notice to the Delhi Police regarding the bail application submitted by Seema Rani Khakha, an accused under the Protection of Children from Sexual Offences (POCSO) Act. The notice was issued by Justice Swarana Kanta Sharma during a hearing on April 3, 2025. The court has requested a response from the police and has scheduled the case for further proceedings in May.

This hearing arose from Khakha’s plea, which challenges the trial court’s decision to dismiss her third application for bail. This previous rejection occurred on February 12, 2026, and the current plea has been filed by advocate Rahul Kumar, representing Khakha.

Grounds for Bail Plea

In her bail petition, Seema Rani Khakha seeks to be released on the basis of having spent two years and nine months in custody. The petition argues that the Supreme Court has mandated expedited trials in POCSO cases, yet only the victim has been examined thus far. Khakha contends that during the cross-examination of the victim, significant discrepancies were noted in her statements, which allegedly contradicted earlier claims made during the investigation.

Seema Rani Khakha is implicated in a case alongside her husband, Premoday Khakha, who was serving as a Deputy Director in the Delhi Government at the time of the alleged offence. The case involves serious accusations concerning a minor victim, raising significant public and media interest.

The prosecution asserts that a First Information Report (FIR) was lodged by the Delhi Police on August 13, 2023, after a hospital raised concerns regarding the sexual assault of a minor girl. This initiated a police investigation that ultimately led to Khakha’s arrest.

Background of Allegations

Seema Rani Khakha has been in judicial custody since her arrest on August 21, 2023. The allegations against her and her husband include severe accusations concerning the alleged sexual assault of a minor. Reports suggest that her husband is accused of sexually assaulting the minor, which reportedly resulted in pregnancy.

It has also been alleged that Khakha was involved in the termination of this pregnancy by providing the minor with medication. These serious allegations form a significant part of the prosecution’s case as they proceed through the judicial process.

A chargesheet has already been filed by the investigating agency, which indicates that the case has moved into the prosecution evidence stage before the trial court. This ongoing legal battle underscores the complexities inherent in cases involving the POCSO Act, where the stakes are exceptionally high.

Next Steps in the Legal Process

The Delhi High Court’s decision to issue a notice to the police signifies that the legal process will continue to unfold in the coming months. As the case moves into the next hearing in May, attention will be focused on the responses from the prosecuting authorities and any developments in the defence’s arguments regarding the bail plea.

Given the gravity of the charges and the involvement of a minor, the legal proceedings are expected to be scrutinised closely by legal experts and the public alike. The outcomes of these hearings will play a crucial role in determining the future of Seema Rani Khakha and how the judicial system addresses such serious allegations.

As the case progresses, it will reflect the judicial system’s handling of sensitive issues related to child protection and the rights of the accused. It remains imperative for all parties involved to adhere to legal protocols and ensure that justice is served efficiently and fairly.
