Chunnari Chunnari Controversy Escalates as Composers Declare It a Tribute

The CSR Journal Magazine

The composers of the song “Chunnari Chunnari – Let’s Go” from the film “Hai Jawani Toh Ishq Hona Hai” have stated that their track is intended as a tribute to the original song from “Biwi No 1”, rather than a remake. This clarification follows significant backlash on social media and a legal battle concerning the use of music from the 1999 film. Composers Akshay and IP expressed their views in a recent interview, asserting that their work is a homage to the classic track featuring actors Salman Khan and Sushmita Sen.

In a conversation with a media outlet, Akshay emphasised their approach by saying, “We have our own term for this, which is reimagination. It is actually paying homage to the original.” He insisted that the label of remake implies a different treatment of the song. He highlighted that their rendition features entirely original lyrics and involved a sampling process, ultimately reworking the words. Therefore, they reject the notion of it being a mere recreation, instead positioning it as an homage.

IP, who contributed to the additional lyrics and performed the track, elaborated on their intent to familiarise younger audiences with songs from the 1990s. He noted, “When we heard the songs, we were growing up. These songs held certain feelings and emotions.” His goal was to maintain the essence of the original while integrating modern musical elements, thus attracting a new generation to the nostalgic tunes.

Legal Action Surrounding the Film

The matter has escalated to the Bombay High Court, where Puja Entertainment, led by Vashu Bhagnani, has filed a lawsuit amounting to Rs 400 crore against director David Dhawan, Tips Industries Limited, and producers Ramesh Taurani and Kumar S Taurani. This legal action is based on the claimed unauthorised usage of songs originally featured in “Biwi No 1”. The main focus of the lawsuit concerns the newly recreated versions of “Chunnari Chunnari” and “Ishq Sona Hai” in “Hai Jawani Toh Ishq Hona Hai”.

According to reports, the lawsuit, lodged with the support of V K Dubey Associates, is seeking immediate injunctive relief to halt the release, distribution, streaming, and any further commercial utilisation of the film. This includes all promotional content associated with the songs in question. Puja Entertainment is also demanding the removal of the songs from the film and has requested a change in the film’s title.

Furthermore, Puja Entertainment claims that the film’s title, “Hai Jawani Toh Ishq Hona Hai”, derives from the controversial song “Ishq Sona Hai.” They are seeking Rs 100 crore in damages should Tips Industries Limited and David Dhawan fail to adhere to their conditions. In response, Ramesh Taurani from Tips Industries has asserted that the company holds the legal rights to the music and audio associated with the original tracks.

Upcoming Release Date of the Film

The film “Hai Jawani Toh Ishq Hona Hai” is scheduled for theatrical release on 5 June 2026. The ongoing disputes concerning the music rights have generated significant media attention, and the outcome of the legal proceedings remains to be seen. With the filmmakers attempting to navigate the situation, audiences are keenly awaiting the resolution of the controversy.

As the date approaches, concerns regarding the film’s availability in cinemas also linger, largely dependent on the court’s verdict. Stakeholders involved are gearing up for potential scenarios that may arise from the ongoing litigation.

This incident serves as a prominent example within the Indian film industry, illustrating the complexities surrounding music rights and the impact of nostalgia on contemporary music productions.
