The Centre has initiated processes to expedite the prosecution of cases related to the NEET-UG paper leak, following Prime Minister Narendra Modi’s call for the establishment of fast-track courts. This move aligns with recent developments and aims to address allegations of misconduct in public examination practices.

As reported by government sources, the accused individuals in these cases will now face charges under the newly implemented Public Examinations (Prevention of Unfair Means) Act, 2024, which became effective on June 21, 2024. This legislation is designed to enhance the efficacy of legal proceedings in relation to examination-related offences.

The Centre intends to engage with relevant state governments and High Courts to facilitate the creation of special fast-track courts. This initiative seeks to ensure that trials are conducted on a day-to-day basis, ultimately speeding up the legal process.

Overview of the New Legislation

The Public Examinations (Prevention of Unfair Means) Act, 2024 empowers authorities to take strict measures against activities such as paper leaks and cheating in public examinations. It encompasses various examinations, including those administered by prominent bodies like the UPSC, SSC, RRB, and IBPS, as well as recruitment tests conducted by Central government ministries. Additionally, all entrance and recruitment assessments overseen by the National Testing Agency (NTA) fall under the purview of this law.

Since the NEET examination is conducted by the NTA, allegations surrounding paper leaks and manipulative practices during this examination now come under the jurisdiction of the new law. This is aimed at reinforcing the integrity of public exams and safeguarding the interests of aspirants.

The introduction of this law underscores the Central government’s commitment to ensuring transparency and fairness in the examination process, particularly in light of past incidents allegedly linked to irregularities.

Planning of Fast-Track Courts in Key Jurisdictions

Reports indicate that currently, four First Information Reports (FIRs) have been lodged related to the NEET paper leak under the provisions of the new law. In recognition of the need for a speedy trial, the Centre is making arrangements to establish fast-track courts in four major judicial jurisdictions—namely Bombay, Calcutta, Delhi, and Madhya Pradesh. This approach aims to expedite the legal proceedings and ensure timely justice for all parties involved.

The data shows that two of the registered FIRs fall under the jurisdiction of the Bombay High Court. The strategic setting up of fast-track courts in these key regions reflects the government’s focus on addressing the NEET paper leak issue directly and efficiently.

The establishment of these special courts is anticipated to significantly reduce delays in legal proceedings associated with such cases, enabling a more robust legal framework to handle public examination-related offences. This initiative, therefore, aligns with broader efforts to uphold the integrity of public examinations in India.
