The Trinamool Congress (TMC), led by Mamata Banerjee, has approached the Supreme Court in response to the alleged inaction by Lok Sabha Speaker Om Birla regarding the disqualification of 20 rebel Members of Parliament (MPs). The petition, filed by TMC’s national general secretary Abhishek Banerjee, contends that the delay in addressing the disqualification petitions warrants judicial intervention. The case will be heard on Tuesday by a bench headed by Chief Justice of India Surya Kant.

Claims by the TMC

TMC’s petition asserts that the 20 MPs in question have participated in activities deemed contrary to the party’s interests and have subsequently merged with the Nationalist Citizens Party of India (NCPI). Abhishek Banerjee contends that their actions qualify for scrutiny under the anti-defection law, which seeks to maintain party integrity in legislative bodies.

The TMC’s legal team highlights discrepancies regarding the status of the rebel MPs within Parliament. While the MPs have adopted a distinct identity as NCPI members outside the House, they seemingly continue to identify themselves as representatives of the All India Trinamool Congress (AITC) when within parliamentary proceedings.

Reference to Anti-Defection Law

Banerjee’s argument emphasises the relevance of the anti-defection law, citing that the behaviour of the rebel MPs justifies expulsion from the party. The petition challenges the delay in resolving the disqualification questions and urges the Supreme Court to act expeditiously on this matter. The TMC references past Supreme Court rulings, including a significant decision from 2023 concerning the Subhash Desai case, which supports timely resolutions for similar petitions.
