Madras High Court Bars Unauthorized Broadcasts of ‘The Kerala Story 2’ Till March 23, 2026

The Madras High Court has issued an interim order preventing internet service providers and cable television operators from unlawfully broadcasting The Kerala Story 2: Goes Beyond, which premiered in theaters on February 28. This ruling came on March 3 following applications submitted by Sunshine Pictures Limited, the film’s production company, which expressed concerns regarding potential copyright infringement coinciding with the film’s release.

Legal Grounds for the Order

During the proceedings, Justice Senthilkumar Ramamoorthy considered the applications and noted that the production company presented a certificate from the Central Board of Film Certification (CBFC) to substantiate its claim over the film’s copyright. The certificate identified Sunshine Pictures Limited as the producer, which was accepted as sufficient evidence at this preliminary stage.

Judicial Concerns Over Irreparable Harm

The judge emphasized that in cases of suspected illegal broadcasting, prompt judicial action is crucial to prevent lasting damage. He stated, “In matters of this nature, it is likely that irreversible injury will occur unless unlawful broadcast is prevented at the threshold. At the same time, it is possible that the legitimate business interest of one or more respondents may be affected, in view of the expansive nature of the relief claimed. Therefore, it is necessary that the plaintiff shall indemnify in respect thereof.”

Details of the Injunctive Relief Granted

As a result of this reasoning, the High Court granted an ad interim injunction that bars unauthorized broadcasts of the film until March 23, 2026. The court’s order specified: “Subject to this condition, orders of ad interim injunction as prayed for are granted in these two applications until 23.03.2026. Issue notice to the respondents returnable on 23.03.2026. Private notice is also permitted. The applicant shall comply with Order XXXIX Rule 3 of CPC.”

The case is set for further review on March 23, 2026, as the court continues to evaluate the circumstances surrounding the matter.
