HUL Files Suit Against Beco Over Allegations of False Advertising

The CSR Journal Magazine

The Delhi High Court is currently addressing a dispute involving Hindustan Unilever Limited (HUL) and home-care brand Beco. HUL has filed a case against Beco’s parent company, Kwick Living (I) Private Limited, over allegations of false advertising. This action centres on Beco’s campaign, ‘WarOnWhatsHidden’, which questions the safety of ingredients used in two of HUL’s well-known products: Surf Excel Matic Liquid and Vim Dishwash Gel. Reportedly, these claims have sparked considerable concern regarding consumer safety and product integrity.

On August 16, 2026, Justice Anup Jairam Bhambhani sought a response from Beco regarding HUL’s request for an interim injunction against its advertisements. The court decided not to halt Beco’s campaign immediately, indicating the need for a comprehensive review of both parties’ arguments. The proceedings are scheduled to continue on August 21, 2026, with Beco required to submit supporting evidence by August 20, 2026.

Contentions from Beco’s Campaign

Beco’s advertising strategy incorporates various platforms, including social media and influencer promotions to contrast its products with Surf Excel and Vim. The company has asserted that laboratory tests identified the presence of Benzisothiazolinone (BIT) and Linear Alkylbenzene Sulfonate (LAS) in these HUL products. The advertisements argue that these compounds are linked to potential skin irritations and allergic reactions, which forms the crux of Beco’s promotional narrative.

In response to these claims, HUL has contested the manner in which Beco has depicted its findings, alleging that the implications drawn are misleading. HUL’s concerns centre around the interpretation of the laboratory tests presented by Beco, arguing that these tests do not satisfactorily demonstrate that the finished products could provoke adverse skin reactions under normal usage conditions.

According to HUL, assessing individual ingredients for safety does not equate to evaluating the overall product formulation. The company asserts that Beco has not conducted appropriate safety examinations to validate its advertisements. This assertion highlights a critical distinction in product testing that HUL claims Beco has not adequately addressed.

Allegations of Misleading Advertising Practices

HUL has raised additional concerns regarding Beco’s use of its established taglines, such as Vim’s ‘100 nimbuon ki shakti’ and Surf Excel’s ‘Daag Achhe Hain’. HUL argues that this practice infringes on their trademark rights and may confuse consumers regarding brand identity. The advertisements are alleged to ridicule HUL’s customer base while suggesting that the organisation has intentionally misled its consumers.

The timing of Beco’s campaign has also come under scrutiny. HUL has indicated that Beco launched its advertisements on the evening of August 14, 2026, strategically close to India’s Independence Day holiday. This timing allegedly impedes HUL’s ability to secure swift legal recourse due to the public holiday period. HUL interprets this as a deliberate attempt by Beco to influence public perception during a period of heightened consumer engagement.

As the court prepares to hear arguments from both sides, the focus remains on whether Beco’s campaign will be temporarily restrained. The ongoing legal actions remind stakeholders about the complexities involved in commercial advertising and the regulatory standards expected within the industry.
