Dr Adish C Aggarwala, a former President of the Supreme Court Bar Association (SCBA) and a Senior Advocate, has submitted a petition to the Supreme Court, aiming to modify a prior ruling issued on July 15. His request is to postpone the upcoming SCBA elections originally scheduled for August 18 to a later date of September 25, 2026. Aggarwala argues that the current timeline is insufficient for finalising the electoral roll, addressing any objections that may arise, completing nominations, and enabling adequate campaigning.

Concerns Over Current Electoral Schedule

In his application, Aggarwala has raised concerns regarding the short timeframe allocated for various electoral procedures. The Supreme Court’s previous decision to hold polling on or around August 18 was based on the assumption that the electoral roll had been finalised. However, the election notification issued on July 24 revealed that a tentative voters’ list would only be published on July 27. Additionally, the notification allowed for objections until July 31, with the final voters’ list scheduled for publication on August 4, suggesting that the electoral roll is still a work in progress.

The application asserts that members of the association have only four days to scrutinise the tentative voters’ list and file any objections within that limited window. Furthermore, it highlights that the compressed timeline provides inadequately brief campaigning opportunities for candidates reaching out to voters throughout the country.

Aggarwala indicated that on July 23 and July 25, he made representations to the Election Committee requesting that these issues be presented before the Supreme Court. However, he claims that despite these efforts to advocate for a schedule change, the election timeline remains unchanged.

Proposed Measures for Election Administration

In the event of a postponement, Aggarwala suggests that the Election Committee should oversee the daily operations of the SCBA until a newly elected body takes office. He stresses that the outgoing Executive Committee should limit its activities to routine and necessary expenditure only, preventing interference with the election process.

Aggarwala, who intends to run for the position of President in the upcoming elections, has positioned his intervention as crucial for ensuring a fair, transparent, and legally compliant electoral process for the SCBA. He emphasises that these reforms are vital for maintaining the integrity of the bar association’s electoral system.

As the situation develops, the Supreme Court will need to consider Aggarwala’s application and the significant issues it raises regarding the electoral framework. The outcome of this request is likely to affect not only the timing of the elections but also the broader process of representation within the Supreme Court Bar Association.
